Timeline

So, the saga continues, and once again I am almost ready to file my AOS (have had a number of false starts and complications with medicals expiring, etc.)

I have been working without an EAD for almost two years now, owing to the fact that there's only so long I could live here with my USC wife and not contribute to the bills and generally socialise and feel some self-worth. I have been paying taxes during this entire time and the employment has been above-board. As I too have, therefore, been contributing towards our household income, and my earnings count towards our being above the poverty line, do I also need to submit proof of my employment status with a letter highlighting my start date, position, and pay, or would that be surplus to requirement.

I have tried to find a definitive answer to this question but can't seem to locate any solid, reliable information.

Also, should the cheque I include for the combined filing fees be $1140, and then I pay the $85 biometrics fee when I attend my actual biometrics interview? Or should I be making the cheque out for $1125?

Thank you, and apologies for what are probably stupid questions.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

your income doesn't count since you are working illegally. your wife will need to submit copies of her w2s to separate her income from yours

 

does she alone make enough to financially sponsor you? if not she will need assets or a joint sponsor

I included both her and my own W2. She makes enough, alone, to place us above the breadline, yes.

 

I'm concerned, however, about how my having been working without an EAD for two years is going to play with my AOS. Surely, the fact that I've been paying taxes this whole time and, thus, contributing to society, must count for something?
