Asylum under health reasons

The Tacoma detention center medical team deturmened that my husband can not flight ever again because of his health conditions. So our lawyer said we should apply for asylum on health reason and the fact that my husband can not go back to Canada or England because he has nothing in those countries to go back to no perminant address, and his health was getting worst over in England while he waited for embassy to approve his immigrant visa which they did not approved because they thought our marriage is fake. Should we believe our lawyer on this asylum visa?

That doesn't sound like an asylum case.

What nationality is your husband? Since his immigrant visa got denied, how did he get to the USA and why is he now in detention?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Before you file your lawyer you should ask what they think qualifies for Asylum. If they say "Well since he can't fly he's unable to go back to his country", that isn't a reason.  Simple googling shows that health or having no place to go back to isn't a reason.

Thats his defence, which is why I am firing him. And that is a good point, about the boat, to tell my lawyer. I just have a ####### lawyer. Charged me $2000 to do absolutely nothing.
