Hi, my dad first entered the US in 1988 on a B2 visitor visa, and he overstayed for 10++ years. Then he got married with a US citizens women and obtained a Green Card in 2011. My question is would I get a good chance to get a B2 visitor visa to US since my dad is living there and hence they may believe I got a higher tendency to settle there? And would they trace my dad overstayed history in the past and punish me instead by refusing my visa? I'm a Malaysian and working in the UK as a young professional (pharmacist) and I got prove of my employment status, bank account and tax paying and been here for four years now. Thanks.

Your b2 is independent off your dad's. You should be ok, but a small chance his overstay might come up to rub off on you.

Hi KierenHby, I'm not sure about that as I have read up a few case studies. It says that during the interview at the embassy they will ask you about your dad and which category of visa did he used to enter US before changing his status to PR and suspect his original intention to enter US with a B 2 visa. And in some cases, they said the children or parents will be punished by denying a visa.

My wife applied for a B1 visa 9 years ago with a US citizen father that had the same path as yours: B1>overstay>marriage to USC>green card.

 

My wife was denied because of weak ties to her home country. They never asked her anything about her father. That's not to say they didn't factor that in when denying her the visa. They just didn't ask her any questions about it.  Good luck.
