Green card renewal? Next step?

Hi guys, its been a while!

I'm hoping I've put this in the right place...

 

My Green Card is due to expire in November this year. It was granted in November 2015. Im just wondering what my next steps are? Do I apply for removal of conditions or renew it? I plan on becoming a Dual Citizen of Britain and America.

 

Also we're expecting our first baby in July and I was wondering if any knows how to make sure he's a dual citizen too? I want him to be able to have both an American and British passport.

You have to file ROC you can file 90 days before the expires date on the GC.

You must file your I-751 to remove conditions any time from 90 days before the expiry date of your green card, through to the expiry date itself. 

 

Regarding your child, by being born in the US, they are a US citizen by birth - that is the easy part.

As for the UK passport, are you or your spouse a British citizen by birth (ie, not by descent?)

If so, even when being born abroad, your child will also automatically be a British citizen and is entitled to a passport.

Next is removal of conditions. You can start gathering evidence now. You can send it is 90 days before your GC expires. DO NOT send it in prior to the 90 day time frame. It will just get returned to you. You can use the guides to give you an idea of what evidence to provide.

If you child is born in the US then it will definitely be a US citizen. As for as having your child also having a UK citizenship I will leave that to more experience members.

Found the removal of conditions stuff on the USCIS website just now thank you

and I'm the British citizen and will still be one when the baby is born so do I register the birth with the UK too? Or just apply for the passport when he's here? Won't they want a British birth certificate? (Sorry, been a few years since I did my own passport application)

No UK registration required - they will need your passport number and possibly birth certificate when applying, so they can verify your citizenship status and that it wasn't gained by descent or naturalisation and are therefore eligible to pass it on to your child.

One/two questions I thought of a second ago. We were hoping to fly to England for Christmas this year so my family can meet the baby, but can I even travel while it's being processed and with an expired green card? Also how do I go about working with an expired card? Upon looking at the processing times, they're about a year behind currently :/ Are there measures in place to prevent you loosing your job and keep travelling?

Once the I-751 is filed you get an extension letter sent to you with a week or so, which acts as proof of your permanent residency for one year from the expiry. This letter is watermarked, and ONLY works in conjunction with your expired GC, so keep that safe.

As long as you file BEFORE the expiry of your card, your status is not affected in any way, including your right to work.

 

As for taking over a year...yep, probably, as I know only too well. You can get further proofs of status beyond the one year letter, and again, your status is not affected.

You get a one year extension letter of your GC. When you want to travel you make an info appointment an get a stamp in your passport and bring that, your extension letter and expired GC with you.
