**Adjusting from initial Q1/changed to B1 then overstay, termination of removal proceedings**

First met: Totally random by asking for directions, June 2014 while on vacation at Disney World (L)

Engaged: Aug. 21, 2014

Married: Dec. 1, 2014

ICE phone contact: sometime in early Dec. 2014- Co-operated, retained attorney who advised the same.

Filed stand alone i-130: January 2015 (VSC)

ICE home visit, schedule time to go to DHS office and NTA issued, date TBD, was not detained and released on own recognizance within an hour: January, 2015.

NOA1: Feb. 20, 2015.

Transfer to CSC to balance workloads: August 2015

1)First Master Calendar Hearing: Sept. 9, 2015-Continued based on pending i-130, new court date in 6mo.

Congressional Inquiry: Dec 8. 2015

2)Second Master Hearing: March 9, 2016- Removal proceedings terminated w/o prejudice based on approved i-130!! Remanded to USCIS to begin AOS process :dance:

The Casablanca consulate is definitely tough, but if you have time and money you could try to apply for a tourist visa if you wanted to. The most difficult part will be proving you have ties to Morocco and will return home. This could be hard for you as a young single woman.There is a very very high chance it will be denied, however I don't think being denied a tourist visa affects any future K1 or CR1 petitions if you are planning to go that route in the future. As others have said, he cannot sponsor you to come to the USA. You said that he might go back to Morocco with you if you were to visit him in the USA, meaning he would be able to go to Morocco at some point, so maybe wait until he is able to travel and have him come and visit you in Morocco. That is probably the easiest way to meet each other face to face, outside of meeting in a 3rd county like Turkey or Brazil (where you don't need a visa to travel to).

You also mentioned that you would be considering the K1 visa. If your visitors visa to the US is denied and you want to go the K1 route, your boyfriend will have to travel to see you as you must have met in person to be eligible for the K1 visa.

 

USCIS website states:

 

You met each other, in person, at least once within 2 years of filing your petition. There are two exceptions that require a waiver:
1. If the requirement to meet would violate strict and long-established customs of your or your fiancé(e)’s foreign culture or social practice.
2. If you prove that the requirement to meet would result in extreme hardship to you.

 

I don't know anything about the embassy in your country, but some embassies are tougher and multiple in person visits prior to filing would be beneficial to establish a genuine relationship.

Casablanca is tough so it is better to get lots of proof of your relationship and spend as much time together as possible.  We filed CR1 and I made several trips over a three year period.  My husband said the interview was tough but we were approved and had the visa a week later.  It may not be possible for you, but try to plan on meeting as many times as you can.

Well from her point of view, she would need to come to the US to have that same experience as you had of meeting your potential life partner in his homeland.  Of course it may not be possible, but it's probably worth a try, because if she does proceed eventually with a K1, she will be moving to live with him, so it would be nice if she could have some idea of what that might be like.

 

Ideal would be for both partners to visit each other, but for people from many parts of the world that is difficult due to limitations on US visitor visas.

I have more time thn he has. Im able to stay for 3 months for summer vacation by this we will spend more time together in real life and get the chance to know each other even much more and have more proofs if we decided to get the k-1 visa later when im back....as if he had to come we gonna be able to meet just for 2 weeks thn he needs to get back to work thn we wont know when he might get the next vacation. Thts why we were thinking about me coming....as im still student i havent finished my university here maybe that might help....i will have to come back before  studies start.

There is nothing wrong with trying get the tourist visa, but be prepared to be denied unless you can prove ties to Morocco. It's hard for a young single person to prove they have important ties to their country, but some examples of strong ties would be having a secure job, owning a home/land/having regular bills to pay or having a spouse or child in Morocco that you would want to return to. Have you ever traveled outside of Morocco? Sometimes having proof of having returned home after going abroad can strengthen your case. 

 

Also this is just personal advice, but maybe try to get to know him a little better before meeting, especially if you are planning to spend more than a few weeks with him over your summer holiday. Not sure if he is Moroccan American which would make your age gap slightly more acceptable, but talking online for only 2 months is something you should be careful with, especially since he seems a bit hesitant to come visit you. I think that you have to meet someone in person before you can truly get to know who they are, so I understand your reasoning for wanting to visit him. I also understand that vacation time can be hard to come by for workers in the USA however, so its a bit of a tough situation. 

 

Anyway, if you don't mind potentially losing money through paying the application fee, I would say go forward with the tourist visa if that is what you feel you want to do. A denial shouldn't hurt your future visa applications (as long as you are honest about your intentions to visit), and who knows, there is a chance you could be approved, as its really all up to the consulate and they can be rather unpredictable. To grant a tourist visa you shouldn't know anybody here , just tell them you go for sightseeing for a couple of weeks or a months, and you have to know the name of the hotel you will reside in , if you mention that your boyfriend will take care of you there you will never ever grant the visa , and you have to return home on time to be able to go again.  But take my advice , let him comes first and meet with your family ,   you barely know the guy , the age difference is considered big. Going there all alone by yourself is not a good sign for a  young girl with no experience  but if your parents agree then forget about what I mentioned here.

She can't lie. If visiting a US bf, she has to say so and be truthful on the ds160, the CO, and\or CBP.

That's not a lie , she is not going to get married or engaged there , she just wants to meet him in person .

Unless your family is extremely rich, the bottom line is your tourist visa will be rejected.  Regardless what anyone tells you - your age, your stage of life and country make it impossible. 

 

Sorry - there is absolutely no chance for a tourist visa

Wow, why would you shoot somebody down like that. She just wants to know how to go about visiting. 

 

I'd personally either apply and hope for the best or wait until the boyfriend has time between building projects to come visit. You won't know until you try. If you have to wait for him to come to you you'll both know if it's worth the wait when the choice needs making. Best of luck and don't let anybody knock you down before you get off the starting blocks.

I dont think you know what tough embassies are like - i have sat in the queue of relatively easy embassy thrice and i know.

 

single people even some older ones are never given visas.  20 year olds going on their own simply never happens.

 

not shooting her down, they simply dont see ties tomgome country, just making sure she understands reality.  I know a friend who was shocked and them applied two more times immediately.  He was then clearly explained to that he would need more international travel, finish two years in last job before he tried again and the fact that he has a child and wife not travelling with him was still not considered ties.

 

having read so much over the years i know it simoly doesnt happen in her combination and the only thing that gives her some chance is if there is excessive parental wealth and shes been to Western countries and returned recently.

 

Her bf is going to have to visit.
