sounds like your fiance doesn't care enough to keep his ex away. Was he messing with his ex? Indeed, how on earth could his ex get through his phone? Maybe you should consider staying away from this kind of fiance for good?

I totally agree with this. As to what you can do... I'd take a step back and really look at what your fiance is up to. Sure, you can refile and spend more money but you need to decide if this person's worth all this effort on your part. I imagine the first canceled petition will come up in the interview... if you get to that stage.

A lot of god advice has been given. Not sure if you can pursue any criminal charges though. Infopass seems like the best option with a refiling. However, I have to point out like others that there is all kinds of Red Flags about the ex and your Fiance's relationship that you should think about.

Holy moly, I've seen many posts from people where I thought ####### but THIS is BEYOND my imagination.

How could his ex manage to get access to his phone, find out where to look for the case number AND knew where to send it.

Like the other people said, RED FLAGS! Talk to your fiance about this ASAP. He either is still really close with his ex or not being honest with you and your relationship.

I agree with the rest, don't get angry with the advice given, you have a few options but it does make sense to talk to your fiancé first and clear some dubious things before fixing it or trying again, since the situation with the ex sounds super shady. Sometimes we don't want to hear it, but things that are seemingly bad happen ''for a reason'' and end up being beneficial for us in the end. It might not seem like it, but people here are concerned about you since they've seen a lot of people being cheated/scammed.  it's better to be safe than sorry, and endure a long and expensive process just to be disappointed.

No offense to the OP, but, this might be one of the most bizarre posts I've read on VJ.  I would be mortified if all the hard work put into this K1 process was taken away in such a matter.  I'm very interested in how this turns out.

I won't get into anything personal about your relationship with your fiance.  Many have already given wonderful advice.  

In terms of your case - I personally would file a formal complaint discussing your situation with the USCIS.  Since Part 1 question 14 of the I-129F form asks you if you've applied for a petition previously, you would have to answer yes and explain the result on line 14.h. anyway.

If she faked being you and stated that your fiance is a "criminal" and that was the cause for cancelling the petition, I'd want history of my formal complaint and true explanation of the situation on file at the USCIS.  If you don't, it wouldn't make sense to a case adjudicator why you would file a 2nd petition with the same fiance, if in your initial petition you stated he was a criminal.  From there, who knows. 

Like with everything immigration related, always telling the truth regardless of how bizarre it may seem, is the only policy.  And this would be something I'd definitely want the USCIS to know.

This whole story seems close to impossible to me, mainly because to get the receipt number, know where to mail - that takes some time and effort. The fiance likely just decided to back out of the ordeal and cancelled it himself.

Dang that's something that's insane.

I don't even think my husband has known any of the case numbers aside from maybe the case number after the NVC and I don't even think he knew that one very well and not until he had to start doing things for the interview.

Either way, it's not something I kept laying around. Def not in my phone.


And honestly does that mean the Ex is looking at ya'lls conversations and such? Something just doesn't seem right.

USCIS wouldn't cancel a petition based on a letter supposedly from

the beneficiary making unfounded allegations. They don't act on gossip. And even if the accusations were true, the petition is all about the petitioner and nothing to do with the beneficiary. If the beneficiary doesn't want to go through with the visa process then they don't complete the DS-160 or they cancel the interview. That's tre part that concerns the beneficiary. The petitioner has the right to petition someone. The foreign beneficiary has no right to stop a USC filing a petition.

I'm going to go out on limb here, but if it was me in your predicament this here will be my thought process: For my fiancé's ex to get a hold of his phone, he must have been asleep, but the question is, who slept over whose house??? To get a receipt number, it takes time to browse through any email to find what you are looking for which means he/she had way too much time on their hands to obtain that receipt number...Not trying to offend or be judgemental in any type of way, but this is where I would have questions that I need answers to..Like the others here advised do what needs to be done...I pray that it all works out well for you...
