I got my interview notice last week and I am not clear about the part in regards to the financial support.

it said that we need to submit the form I-864 with all required evidence unless already submitted, which we already have submitted (one filed by my wife and one by our joint sponsor).

So do we need to provide an updated I-864 form that includes the 2006 tax returns??? in addition, when we sent in both I-864s, we sent in IRS transcripts from only last year (2005), so do we need to get transcripts for 2004 and 2006 too?

in addition do we need to get a letter from our joint sponsor's employer, and his last 2 months pay stubs???

below is what the letter stated?

YOU MUST BRING THE FOLLOWING ITEMS WITH YOU:

*A completed affidavit of support (Form I-864) with all required evidence, including the following for each of your sponsors (unless already submitted)

*Federal income tax returns and W-2's, or certified IRS printout for the past 3 years.

*Letters from each current employer, verifying current rate of pay and average weekly hours, and pay stubs for the past 2 months.

Bring in the last 3 years pay stubs, and a new letter from the employer (for both sponsor and co-sponsor), along with the last 2 months paystubs (again from both).

If you are working now, you could bring in proof of your income and submit an updated affidavit of support (that's what we are doing, even though we met the income requirement already).

I believe what was meant by jane was the last 3 years transcripts easily obtained by calling IRS. Each sponser will need to have a current letter from their employer with current rate of pay average weekly hours and pay stubs for the last two months and evidence of their USC. Good luck,

Do you have to bring a letter of employment to the interview? I mean the pay stubs already state the hrs worked and the rate per hour.

here is the problem,

Both my wife (U.S. Citizen) and I are in graduate school, and I am the one who is making the money through a Teaching Assistantship. When we filed for AOS back in december, our income did not meet the 125% poverty line so we used a joint sponsor, now when we filed the 2006 taxes, we actually met the 125% of the new poverty line, but the problem is that my Teaching Assistantship will end a week after or a week before my AOS interview (i have to double check my contract). so my question is, under these conditions, when we go to our interview, can I request to use our income alone as Affidavit of support without using my joint sponsor? I am not sure if i will have a new job lined up by the time my interview comes.

In order to be safe, i will still take my joint sponsor's affidavit with me just in case.

I just wanted to see what you guys thought of my case.

I know when I went for my K-1 visa interview I had taken in what amounts to pay stubs in the military. The lady preparing it all was not too impressed but the man who actually interviewed me was not too worried I guess because he didn't mention it. I am sure that it is sometimes okay to not have the letter. But, because they ask for it I would suggest having it just to be on the safe side.

Pay stubs only prove that you were employed (you may have been laid off before the interview), the employment letter is supposed to prove that you will continue to be employed. So yes, you should take one.

However in my experience I wasn't asked for any of this stuff in my interview.

Take what it says in the letter. Don't think pay stubs are sufficient to not have a letter of employment, especially since it says in the letter that not bringing any of the listed items will result in denial - why would you want to risk it?

Bring what it says. Pretty self-explanatory.

My mom is my cosponsor, so she's getting all the stuff listed as well.

Exactly. Bring everything the letter asks for. Don't try to rationalise why you don't have to.
