Hi there everyone, 

 

A few questions i have regarding thr application process for the K1, but first a brief explanation of our current situation. I've visited Co in Aug of last year and travelled back to Canada in Nov, when trying to return i was denied due to improper paperwork (the officer said i should file for the K1 as i intend to marry my fiance). We are in the process of gathering all the documents and paperwork needed to file for this Visa. My questios would be, am I able to travel to visit my fiance and are we able to file for the K1 once I am there visiting? Will visiting somehow interrupt the process or will it be beneficial? If i have a round trip ticket and only visit for up to 2 months as well as having a perminate residence in Canada as well as strong family ties (my daughter) will i be refused entry? I wouldn't want to do anything that may potentially mess up this process. Thank you in advance to all who offer answers and advice.

Yes, it is OK to visit while your K1 Visa application is processing.  This is discussed at length here:

When trying to return you were denied for improper paperwork?  What paperwork did you have?  Were you returning back to Canada from the US?  Or denied trying to go to the US?

I was denied entry to the US,t the person i spoke to basically said it was due to not having proper paperwork. I didnt have any at the time and he said it was also because i didnt have a date scheduled to return. I assume if i have a round trip ticket i should be fine. Am i able to apply for the K1in the US while im from CANADA? I was wondering that because i would have help from my Fiances mother.

I am assuming you have a valid Canadian passport, no criminal record, and have not been denied entry to the US in the past - then there should be no problem at the point of entry.  

 

I am unaware of any "proper paperwork" needed at a point of entry under a normal visit other than your Canadian passport.  I find it odd that a border agent recommend you file for a K1 Visa because this "proper paperwork" was missing.  None of this makes sense.

I would first find out specifically what this proper paperwork is.

Under normal circumstances, your US citizen fiance can file a petition for K1 Visa while you are living in Canada.

I'm having a very hard time following your situation.  Maybe another VJ member can offer assistance.

 

I recommend getting yourself familiar with the K1 Visa guides, timeline, and process here on VJ.  
The nolo.com and rapidvisa.com websites have great information as well.

Also, do a video search for K1 Visa on YouTube.  There are a lot of great videos with a ton of great visual information.

Sorry i was unclear. I had went to the US in August of 2016. I came back in November the same year. Once back in Canada we visited my family and when we went to return to Colorado my fiance was sent home without me. I didn't know i wouldnt be allowed back until about 5 minite before out flight after over an hout of answerig questions. I was then made to sign a copy of all the questions i was asked to confirm my answers where turthful and correct. Which they where. I was honest and said we had been travelling back and forth and i planned on moving with my fiance eventually. Which of coirse raised red flags to me staying illegally, the officer at the airport had me finger printed and then made the suggestion we apply for a K1 Visa seeing as we are engaged and plan to marry. I was in such a fluster i thought he said i was unable to enter due to paperwork. Which i guess could have meant i didnt have a visitors visa? Regardless, ive been here since November trying to figure out the best way to go about this. I need to see him because being apart for so long is the worst heart ache i have ever felt. So i was curious as to if there was a proper way to go visit where they allow me to stay 90 days. Once the time is up we would like to come back and visit my family in Canada for the summer and wait for the K1 to finish and go to the interview if it hadn't already been done. Again i apologise for the confusion. The last few weeks have been taxing and i was so flustered responding properly. I hope this information helps and if you need more feel free to ask. Thank you

It sounds like you plan to stay with your fiance for several months at a time. I'm not an expert by any means, but I think it will be helpful if you can have the return ticket booked. I have been visiting my finace once a month from Vancouver to LA in the past few months. So far, I have no problem at all! Make sure that you can show them your intention to return to Canada.
