I-130 Petition Fees Wrong

Greeting, 

I submitted my package for my wife three weeks ago and it was rejected due to the filing fees being incorrect. I pulled the fees from USCIS website and went to the hermandad office this morning and they said the fees were also incorrect even on the USCIS website. I need some assistance for the current fees thank you.

You missed the biometrics fee for i-765 and i-485, it's  $85.

 

Also, are you sure that you should pay for the i-765? It was for free for me when I filed for i-485 at the same time, but it might be different? If you apply for a CR-1 visa you don't need the i-765 at all, she'll get a greencard instead.

Thank you for the info, i don't know how i missed adding the biometric fees. The I-130 however immigration said the fee of $535 was incorrect as well. For the I-765 authorization for employment technically i dont have to submit it but my wife would prefer to work during the whole process.

So you're not applying for a CR-1 visa then, you're adjusting status from another type of visa? If so, then yes you can file for i-765 and it's for free. So you missed that as well. 

 

If you are adjusting status from a tourist/work/student visa, then these are the fees for you:

 

I-485 = $1140

I-130 = $535

Biometrics = $85

I-131 = $0 (optional)

I-765 = $0 (optional)

 

$1225 on one check (i-485 and biometrics) and $535 on one (i-130).

I bet they just sent the whole thing back when the fees for some parts of the package were wrong and put a generic reason for the rejection, and that's why it looks like you sent the wrong fee for the i-130 as well. They love generic answers and often they don't make 100% sense.

Yes it is a CR-1 which includes the fee for the I-765 correct?

When you file the I130 together with I-485 there is no fee for I-765 or I-131..... therefore your checks should be $1225 for I-485 and $535 for I-130

 

my apologies I just realize she's not in the USA forget about I-765 it's only when you're here and adjusting NOT for when she's in her home country

No. You apply for a CR-1 visa if your wife is still in her homecountry. That means she has zero use for a i-765 as she can't work in the US anyway (she's not even in the country!). When she receives her CR-1 visa and moves to the US she will automatically get a greencard, there's no use for a work permit.

If CR1, only $535 is needed to file the I130. Other fees will be required later in the process.
