Yes! Tax returns are required for the K-1's I-134. You can request for your tax return transcripts from IRS' website.

 

Don't forget the letter from your employer and the last few paystubs.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

Yes and No.

The most recent tax return is required but NOT the last 3 years of tax returns.

Each consulate differs, but so far I have not seen any consulate ask for three years of tax returns, only the most recent.


Either way, a tax transcript is still the best thing to provide, along with what the above said, letter from employer and a few months worth of paystubs.

What about W2 can you used them instead of transcripts

Consulate officers reviewing cases are human and make judgements based on their experiences.  Also, depending on the country, some Embassies are tougher than others.  Although there are minimum amounts of proof required, it is always better to have more proof than less.

That's why many VJ members "front load" their applications with extra-evidence, to make the CO's decision easier.
 

I've read a lot of VJ member's experiences.  And generally, this has been what has worked:

 

  • 3 years previous tax transcripts
  • Previous year's tax return and W2s
  • Bank statement

 

Some have shown less and have had no problems.  Other's have shown less and were refused.  Some had everything ready to show the CO, and they didn't even look at their tax paperwork - and yet were still approved!

It doesn't take much effort to get your tax transcripts via email from the IRS website.  Bank statements are easy to get as well.  And it already sounds like you have your W2s.  

When it comes to immigration, its better to be over prepared than under.

Thank you...you correct safe to have more than less...I was audited this year due to my tax preparer error.  I just don't want anything negative especially not at my fault to deny an approval

IRS tax audits are a part of life.  They happen.  CO's reviewing your case want to see you have consistent, documented proof that your income is above the poverty limits for your specific house hold.  If you have the same employer/employment with the same steady income for the past 2-3 years, having those previous year's transcripts will only help your case.  The bank statements with consistent payroll deposits from your work will also strengthen your case.

 

If I were in your situation, I'd have your tax preparer write an admission of their mistake causing the audit on their company letterhead and submit a copy of that letter along with your Affidavit of Support form.

If you provide a W2, you will have to provide the 1040 that is associated with the W2. The 1040 is your tax return, and your W2 is a supporting document for your tax return.

You don't need tax returns, all you need is evidence that the petitioner can support the beneficiary financially. A letter from the employer and/or a bank statement also works. I'd recommend more than one form of evidence.
