My husband also filed for the I-765 previously. So now i'm asking for a new EAD card for him under Aos. My question is- do you have to send a copy of his previous EAD card along with the previous acceptance letter?

Hi,

The previous acceptance letter is not necessary, just the front and back of the card. We used the A-number from his EAD on all AOS documents, but then the NOA1's came back they had a different A-number on them. If that happens to you don't be alarmed, we called and they said the OPT EAD has a non-immigrant A-number, so they will give you a new one for immigrant cards :)

Hi there! I had a couple of questions about the new I-130. My wife is here on a J-1 and we just got married.

 

On part 4 13a. Provide beneficiary's address outside of the United States do I put N/A?

 

Part 4 21. a.  & 25.a. (name of beneficiary's spouses) This may be a stupid question but do I put my name? Is this mostly for beneficiary's that aren't spouses or divorces?

 

Part 4 48- Travel document number- I thought that would be a passport number but it asks for it in the question before

I had questions about all of those too! I did put N/A for foreign address, he has been here for 3 years and his parents don't live in his country anymore. I did fill out his old Iranian address on his I-130A though. 

 

For 21, I put myself and left marriage ended date blank. 

 

I left 25 blank and all other family spaces in that section because it refers to family members of theirs that are also petitioning to come to the US. 

 

I left 48 blank because the passport number and visa number were filled out elsewhere. 

 

My I-130 and I-130A were accepted with no RFE, so I think you will be ok doing what I did on those forms!

Your OPT renewal should be fine. We submitted an expedite request for the renewal and it was denied, because my husband is currently unemployed. They wanted a letter from a job on company letterhead after we requested the expedite.

Thanks! I was told in another forum that because my current EAD is OPT-based and I am applying for EAD based on my change of status application, my EAD application will be denied because it is not a "renewal." She told me this should have been sent as a brand new application for an EAD. Any comment?

They are misinformed, even though it is a new code for AOS (C9) it is still a renewal because you already have one. Ours has been pending for 60 days so far and we haven't received an RFE or rejection for it, and they considered the expedite, so I know it's not a problem that we put renewal :)

I will work on that! I had a lot of questions that didn't seem to be answered online already. For example, my husband had an EAD but they changed his A-number on our AOS receipts. I thought it was a typo for them but immigrant A-numbers are different from the nonimmigrant one he had before

I have a question...My Fiance and I are getting married at the end of June in Tbilisi, Georgia. Upon my return I will file the CR1. I want to put my husband's name on bank accounts, life insurance etc....Is that even possible with him not being here?

Hi, I added him to my credit cards, car insurance, beneficiary to my retirement accounts, and my benefits at work without him needing to do anything. The bank would not let me add him to my bank account until he was there in person though. We had enough other evidence (listed above as well as cosigner on a loan) that USCIS accepted without needing joint bank accounts :)

I was reading your post - so it seems that - in Q1 - i765 - we are "Permission to Accept" employment? or are we "renewal of my permission to accept employment?"

 

I am currently on a f-1 OPT that expires in Aug 2018. Not sure what to put for the first question! But I am completing my AOS Concurrent filing.
