It is not evidence of a marriage. It is evidence of a bonafide marriage. That means the marriage is genuine. Affidavits from family members. I sent in 4 affidavits: one from her father, one from my mother, one from my best friend and one from her best friend. I also added my wife to my life insurance policy and sent that in. It is proof beyond marriage certificate.

Remember the term bonafide takes the adverbial form in this. Literally means without intention to deceive. Bonafide Marriage- Marriage without the intention to deceive. This is my English Teacher coming out right now. lol

It really isn't simple, it is a ''one day at a time'' process, some days are better than others. Although it is a very frustrating and emotional process, we are not totally powerless. We have to take control of our lives and find ways to stay afloat, since this is just one, one and a half years vs. what will hopefully be a lifetime of happiness with our loved ones. If anything it will give us a hell of a story to tell, with lots of ''awwws and ''oooohs''

➺ 02/04/17 Petition mailed 

➺ 02/08/17 Case Assigned to USCIS Nebraska, sigh. 

➺ 02/13/17 We got our NOA1! PD: February 8th 

➺ 12/15/17 NOA2 finally! after 10 1/2 months. 

➺ 12/21/17 NVC confirmed they received our file 

➺ 01/22/18 Documents sent to Rapidvisa 

➺ 02/05/18  NVC received our package 

03/15/18 Case complete! 

06/27/18  We got our Interview date! August 28th 

08/30/18 The package arrived (waited at Juarez)

08/31/18 Entered the U.S with my husband 

➺ 02/13/19 Husband confesses he cheated, leaves

➺ 02/16/19 Husband decides to abandon the marriage

➺ 05/13/19  I am officially divorced. 

 ➺ 07/03/20  I file to remove conditions on my own     

 ➺ 08/13/21 I finally get my biometrics appointment 

➺ 02/26/22 I got my interview assigned: March 31st.

a lot of couples go through the CR1 without having been married for two years. My previous CR1 from years ago was approved after just 6 months of marriage, and we didn't even send supporting documents like affidavits.  That is the whole point of the Conditional R1, you've been married for less than two years which results on the need of the ROC. Although we might face more scrutiny, it doesn't automatically mean they will think it is fraud.

Again, it is and should be about proof.  Think third party evidence. I suggest we all keep as much of this up to date as possible because you never know what you may be asked.  Five months after NOA1, a USCIS officer may want confirmation that we are all still in the game for the right reasons.

Confirmation and extra information if required is totally fine. I was just saying that a marriage younger than 2 years isn't automatically considered fraud by USCIS, it's case by case. Many people like my husband and I want to start our lives together in the U.S and that's why we applied before the 2 year mark. We did send affidavits from friends. And we are gathering evidence of our trips (7 trips total) with airplane, tickets, pictures and more, to bring to the interview. We frontloaded just in case. We know that USCIS value ''in person'' time as well as financial co mingling, but there isn't just one rule or one thing they require as additional proof of bonafide, there are many options, the more the merrier. Good luck!

We are in the same boat.  We married and then applied.  Doing so is absolutely no different than doing a K-1, the wait is the same and so is the outcome. It is just about where you're married rather than how long.  I guess I am cautious because it is too easy to poke holes in a file, but not one that's legitimate and well supported.

I'm considering getting he and his son tourist visas but don't know where to start. We are 5 1/2 months into our process. Does anyone have experience with this and can point me in the right direction?

It is not a good idea.  I think other forum topics discuss this topic.  The government could view your application for a tourist visa as circumventing the family visa process, and deny both.

You can start by filling out your timeline and it will populate a estimate of when to expect an approval. Just sit and hold tight as you can wait 6+ months for an approval.

Yes it's on your profile. If you look under my VJ username you should see "Timeline" under the Mexican flag. You can see information of what petitions and waivers a user has applied for and when they were approved.

To add on to this, my wife and I just celebrated our one-year wedding anniversary at the time when I sent in my CR1 packet. We didn't experience any problems. 

 

We provided a joint checking-account statement, a copy of our apartment lease (we live together abroad) containing both our names, a few notarized letters from friends who attended our wedding, multiple flight itineraries showing both of our names, a few hotel bookings that showed both our names, my engagement and wedding ring receipts, a couples spa receipt that showed both our names, and some pictures from our wedding and honeymoon. 

 

They review the totality of the evidence provided -- financial documents carry the most weight. Affidavits, while helpful, carry the least weight. 

 

Don't feel guilty if you provide an excess of documents -- the more you provide, the better your chances of a smooth process.
