Divorce date: Wait on court papers?

Hello everybody,

 

I have been in a very unhappy marriage and finally got divorced. Found a wonderful woman while legally separated.

Have two questions please.

 

1.) After the mediation, the papers have been filed in court by my laywer. Do I need to wait on the official paperwork or can I use the mediation date as the official divorce date? The one I will use in the K1 fiancee paperwork.

 

2.) I met my fiancee during legal separation, before I was officially divorce. Can I use that trip for proof of relationship?

 

I appreciate any help, as we would like to file this ASAP.

You need the Final Divorce Decree  ( Certified copy) signed and dated by the Judge to show USCIS your fully divorced before filing the K1 petition. ( Certified copy)

 

I would go and see her again before filing,   Were you on a business trip when you met her?  If so. YES, go and see her . Better safe then sorry.  Take lots of pics together of you , her, her family and friends.   That would be good.

You need to wait on the official paperwork, the one signed by the judge saying you are legally without question divorced.


Also there is no technical proof of relationship, you just need proof of having met in person within the last 2 years. I would probably recommend having another trip to visit them, but you'll want things like passport stamps, credit card receipts/hotel reciepts, something official showing you were there in your fiances same location. Note that photographs are secondary evidence and if you only send photos, you will be RFE'd for something like a passport stamp or a plane ticket,

Thank you very much for those answers. And thank you for the tip with the images vs receipts, that is interesting. We have many hundreds of pictures together, but I am not sure if I kept the actual receipts.

 

Are hotel vouchers and credit card statements good enough? Of course I have the plane ticket receipt.

Yeah, just highlight the relevant info on the statements. Hopefully it can pull up a location the card was swiped. Anything else you may have, again like a passport stamp.
