Name for Spouse on Taxes

HI All,

I had a question regarding name to use for filing taxes for my spouse(non USC). The Social Security card has her maiden last name while all the adjustment of status has her married last name. What name should I use on the form and the first year election statement ?

Timeline

You should always use her legal name. If she changed name when you got married then that's her legal name.

 

You can go to the SS office and have her name changed on the card.

Question: Do I need to change my maiden name to my married name on my social security card for us to file jointly?

Answer:

No. You can elect "married filing jointly" filing status without changing your name with the Social Security Administration (SSA).

  • Make sure that the name shown on your social security card matches the name you use on your tax return.
  • If you haven’t changed your name with the SSA, you'll need to show your maiden name on the tax return instead of your married name to avoid delays.
