Filing I-751 in advance?

Hi everyone,

 

with all the nonsense happening with Visas right now and the possible budget cuts, would it make sense to file the I-751 in advance?  The stuff I read on USCIS website said that it needs to be filed within 90 days of the green card expiration.  Just wondering if we have to wait that long.

You do have to wait for the 90 day window to open, unfortunately. Not much we can do to speed up the process, really. If you want to be proactive just make sure you have everything ready and organized, then you can file as early in the window as you like. Just not before.

Thanks!  Does anyone have any idea if the response is usually sent before the expiration (assuming that all submitted docs are in order)?  I'd hate to lose my job because my card expired.

Yo have to wait.... they will return the package back to you if it's too early. No other choice but to send it within the 90 day timeframe...

You'll get an NOA1 very soon after you file, which will give you a 1 year extension while they process the I-751. You won't be out of status.

Typo it is 90, but I think you got the message.  QueenComley,  Sending it back or dumping it in the basket  conveys the same meaning.  Do you want to embark in a stupid argument? The answer remains, do not mail prior to the 90 days, period.

IT does not "convey the same meaning". If they send it back, you can just wait until the window opens and resubmit the same package, that's the whole point.

I think that almost anybody reading my response would have gathered the fundamental meaning, DO NOT mail the packet prior to the specified 90 days.  When I said they would "dump it in the basket", what I meant is that it was not going to be considered.  They are not trashing it, shred or burn the packet.  They will of course return it to the sender.  The point again is, do not SEND the package prior to the specified time.

Thanks for the responses.  Does anyone have an idea of turnaround times?  Are the ROCs usually processed within the 90 days or are we going to be playing the waiting game like we did when we first filed?

Depends if you are filing at California or Vermont. Vermont takes approx. 100 years to approve ROC cases, California, however are faster LOL. I am a Vermont filer. Got approved March 5th this year... took nearly 16 months. Without any RFE's. Crazy.
