NO "UNTIL" DATE STAMP ON PASSPORT????

Hi:

 

So I want to start working on paperwork for my mom and dad who are in the USA at this time BUT I just realized they do not have a stamp in their passports that says until when are they able to stay in the USA?

 

Also, when I looked online for their I-94...it shows me the previous one to this one which is from their entry back on 12/02/16 leaving 02/05/17. They returned back to NY ONLY a month after leaving...does this mean previous stamp (until when) is the one we should follow???? 

 

Prior stamp was: 12/02/16 till 06/01/17

 

Any advise will be really appreciated.

We need some more info, like where are they from and what status they entered in as? B2?

 

Are they Canadian, given the 6 month visit allowance? Do note that sometimes Canadians are not given an I-94 upon entry without a visa, and USCIS would know this when filing. Do not use the previous I-94 or stamps as that is no longer the case, since they left the country on that I-94.

Hello Zilchfox:

 

My parents are Peruvians and came to USA with a tourist visa ( I believe B2) from Peru to NY. Last visit was for 2 months and they got stamp I mentioned before due until 06/01/17. This visit is for 6 months but not Until date had been provided.

 

I know because of previous visits that the longest they can stay with that visa is for 6 months BUT what I was not sure is if it matter or not that they do not have such a "until date" now.

Hello again:

 

This site was extremely helpful when I applied for a K1 many years ago. I do hope people here can help me now that I am working on applying for my parents who are in NY on a tourist visa now and who will be doing everything from NY.

 

I know all forms I need but while working on I-130 , I found out that questions about I-94...which I know you can get it online now; but when I looked for theirs I only found they one from last visit that was on Dec 2016 which says that their entry is valid till June 2017 . Therefore, i am reaching out to this site. May be I need to wait a little bit longer for new I-94 to show online? They came back again on 03/07...

 

What do people think?

 

We are peruvians by the way!

You can apply for them while they are here in the USA with AOS then it will all be done here & they will not have to return to Peru, however I think they have to stay in USA until their AOS is done?  That was the process when my husband applied for his parents.

Do they plan to return to Peru in September? Seems like a quick change of mind since entering on a b2 just two weeks back.

Good afternoon, 

 

Reason behind their "quick" decision as you mentioned is that I was diagnosed with cancer on February just before they were scheduled to go back home. So I asked them to go home and returned once my treatment started and that's why a month later they came back. And because they are only allow two stay for 6 months at the time. By me doing this, allows them to stay longer and to be here for me and my two small children.
