Got my K1 Visa in October, married on Dec. 2nd, 2016.... applied for AOS, EAD, and AP and received receipt by the end of December 2016... Had biometrics appointment Feb 3 and still haven't heard anything!! Is anyone else struggling with the wait time and the unknown??? I am starting to go stir crazy with cabin fever. I was hoping to travel back home to visit my family and friends in May/June but am thinking it is not going to happen. I am completing online courses for my Masters program so that is keeping me busy. I feel so stuck.... I want to be able to visit my family during that time as there are events going on.... It feels so strange not working as well... starting to feel like I am depressed, etc.

I'm sorry you're feeling stuck! 

My husband got here in Jan 2016, we got married in Feb, and applied for EAD, 131, and AOS immediately. Everything was approved in June, but we didn't get biometrics appt letter until August. The appt was for September, and we received EAD in end of October. 

 

We only JUST got a letter for our AOS interview, to be at the end of March. So it's been a year from applying to interview. Talk about stuck! 

 

However, based on your timeline, it seems to be going faster than ours, so hang in there! Texas is a lot more congested, so your wait shouldn't be too bad from here. 

 

Keep calling USCIS to check in. we called probably twice a month.

You're really just going to need to be patient during this process. Didn't you kind of understand before going into this that you may have to spend a few months unemployed and unable to travel? and that living in a new country..you may just have to miss some things back home? Like..I didn't get to go to my grandparents funerals who both died last year, but that's just the choice I made..

 

I applied for AOS/EAD in March 2014 and didn't get my EAD until June. Then didn't get my AOS approved until the end of January. No interview/RFE or anything, just silence for 11 months. 

 

After working so hard to save the money for the move and everything..i personally welcomed the break from working

Took 4 months for my AOS to get approved & 2 months for my ROC. This was back 2008 & 2010. Now it seems like forever to wait! I just applied for my N-400 on 2/28 & waiting to receive my letter for biometrics. We'll see how this go. 

Finally I'm a 🇺🇸 Citizen!!

In that case, the spousal visa would have probably been the best path for you. It takes a year apart but once you immigrate, you can work and travel and do anything you want the second you set foot in America.

 

I don't know how many similar posts I've seen from k-1 holders. That's why it's important to do your research and think before making a decision.

Feb 1st 2016 - Sent more in-depth info on assets as requested. Received the next morning

April 14th 2016 - SSN received


May 10th 2016 - First day at my new job :dancing:

Does your spouse know how you feel?

Also, May/June is still a way aways. Normally EAD/AP takes 90 days to approve, which means you should have it within the next month or so.

My husband was stir crazy because he wanted to work, but we knew that visiting wasn't going to be possible for a while so I guess not having that chip on his shoulder was a good thing for him.

Much like the K-1 visa process where you shouldn't make plans until you have the visa in hand, when you do AOS there's no point in making any plans until you have your EAD/AP in hand, as it'll just cause unneeded stress.


But yes, this is one of the downsides to the K-1 visa. Once you're at 75 days you can put in a service request, but again you'll probably just be met with the response that your case is within normal processing time because the average wait time is 90 days.
