Question about k1 visa refusal and sending incomplete packet for k1 visa

Hello everyone. I have been reading a lot if info about k1. Can someone help me about my case? I have been refused on k1 visa year 2013 because the CO said I might mostly be a public charge when I get to the USA. Me and my ex fiance broke up. Years passed and I met someone new. Now my fiance filed a new k1 visa for me. We got pur noa already last february 17th. I just wanna know if the old petition could affect my present petition. And the other thing is we have figured out that we sent an incomplete packet.? Do you think it will all end to visa refusal or denial again? Thank you. I will appreciate all of your response. You might get an RFE saying that USCIS wants to see more documents. You can send the missing documents then.

ROC Timeline

08/16/19: sent I-751 packet to USCIS Lockbox in Dallas

08/19/19: packet received by USCIS

08/21/19: received text message with case number ( Texas Service Center)

08/23/19: check got chashed

08/26/19: received extension letter in the mail

11/14/19: Biometrics appointment

04/28/20: case got transferred to my local field office in Atlanta

05/28/20: New Card Is Being Produced

05/29/20: New Card Got Approved

06/02/20: We Mailed Your New Card

06/03/20: The Post Office Picked Up Your New Card

06/04/20: Card Was Delivered To Me By The Post Office

Hello @Becci391 thank you. I hope they will just send us rfe. But have you read cases just like what I had here on vj?? I am just new member here. I am worried about my old petition.

Your old petition is probably dead.  You may want to send a letter asking that it be canceled if it hasn't already died.  If you did not go through with the first K1 application then it will not have a bearing on this K1 submittal.  This is a long and drawn out process and you need to keep in mind that it is just that. Long!  Don't get worried now, as there is not a need. Just relax and follow the directions for the process. Good Luck.

Thank you @Greenbaum?I appreciate your response. I am really hoping and praying that it's died and won't affect my k1 visa petition now. Honestly, I am really worried about it because of info I have read here on vj. I am just a new member. I learned a lot about k1 here. And the other thing is I have contacted us embassy Manila last dec about my old petition. The Lady said since I have been refused the case is closed but she said if I wanna make sure about it she gave an email address of us embassy manila to inquire about it. At first they told me to send them an email why I wanna cancel it. Thats what I did. And I got a response from them that I can't cancel it. Only my ex or the petitioner could cancel it.? I am so worried and confused.

Will the old petition affect your new petition?  Doubtful.   And the fact it has been years since the last petition is a plus in my book.

 

Did you get your NOA1 or NOA2?  You said your petition package was missing a document, what did you not include with the I-129F??   If you are at the NOA1 stage and it is required for the processing you will get an RFE to send that document to USCIS.   Be prepared for the RFE, have the document/evidence ready to response.   

 

If it is something important and you are at the NOA2 stage, you could bring it to the interview at the embassy, that way you are prepared should they ask  (but DO NOT offer it or mention it if the CO does not question on this... let sleeping dogs lay)

 

Visa chase and citizenship.. DONE!

I am really hoping and praying it won't affect for I don't know how to cancel it since me and my ex are not talking at all and it happened long time ago. Yeah, we missed a lot I think.  He just sent I-129f, his letter of intent and the cheque payment. We missed g325a (for both of us) and picture (both of us), my letter of intent, his divorce paper, birth certificate, evidences. That's why I think they might denied our petition because of it.? Hope not.?? Yes, we already got our NOA last FEb 17th. I am just new here on vj and I am learning a lot about k1.

Did you include the CHECK? :lol:   If they cashed the check USCIS wil most likely do an RFE for all the missing documents.  But they won't deny because of that.  Worse case they will send the whole packet back with a DO OVER note ;) 

 

Seems like you rushed things for sure, and didn't check to make sure you had everything needed..   Take the time to read through the I-129F instructions and get everything prepared that you missed.

Haha!? Yeah, sorry the check!? Yes they already cashed it. Thank you so much!? It's a big help!? I will read this. Do I need to send my g325a and letter of intent on his mailing address? They might need all original documents.
