Hi everybody I have a question about the Tax Return and W2, My fiance still didnt file his tax return from 2016, But he already have the W2 form from the both Jobs he Works and my interview is match 28th, I would líke to know if i can Bring only the W2 or they will ask top for the Tax Return ?

If he has the w2's then why not just file? To bring only the w2's would be an incomplete return. You can show the same information with year-to-date earnings from the December pay stubs. w2's should be accompanied by a completed return, there purpose is for filing taxes.

I know he should file, But we dont know if we have more time because my interview is on march 28th.

--also, if you don't have the 2016 return.... your should have the 2015 return and w2's and potential other existing tax schedules.

Just file as soon as possible. Most likely you will be put in administrative processing until you present the latest tax return to the. Once he has filed, he can just make a copy of the 1040 with his signature... he has 2 weeks... shouldn't take more than a day to get together.

alright, then your possibility of not needing the 2016 return is bigger :) but will be a matter up to the adjudicating IO, since it is tax season. You might get by and you might get asked to supply the return as soon as you can. Like I said a copy is fine. Either way it won't delay you much, if you are asked for it.

I agree w/ suss&camm, it only takes an hour or two to file your tax return, so why the worry of your interview being days from now. Bring your own signed paper filed return along with its employee copy of supporting docs and you have an original to present during your interview.

i did this, file a paper -mailed return and submitted a copy of this to NVC for my AOS requirements ,just telling them the irs transcripts will be submitted during interview when available. I was informed it takes 6 to 8 weeks for the transcripts to be available. so you have the same reason why only a paper- filed 1040 to bring to the interview.

If you bring in the W2s, make sure you bring along the corresponding form 1040 :) However, best to have your fiance file his 2016 taxes now so that he can request for the tax return transcript if your embassy asks you to submit it after your interview :)

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.
