It's always the applicants' burden to prove.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

It's the beneficiary's obligation to prove that they are qualified for the immigration benefit being pursued. So they have to prove the marriage is bona fide. They can (and will) deny benefits if they think the relationship is not legitimate.

Think of the proof process as if you were proving it in a mail-in court :). That's what you need to do: prove it with paper, with tangible evidence that it is indeed a bonafide relationship and marriage.

I'm willing to go to any extent including mingling our finances and everything else to prove that our marriage is indeed legitimate. I'm also willing to have sex with him in front of them if it comes to that. But when they discover my already existing relationship, can they just deny the petition THINKING that that marriage is not bonafide? I mean, this is too much of a risk for me. Because if it comes to that, Steve would be deported just because of the opinion of immigration.

If your marriage is your primary, (from the sounds of it, you guys do not do hierarchy poly) I feel like they should have no say in the matter, since swinging is technically legal...

I think you're kind of jumping the gun here; he can't be deported if they don't admit him in the first place. Slow down, concentrate on your impending marriage to Steve, and forget about the rest. If they ask you, whatever you do and whatever it is, tell them the truth.

Steve is already here, he lost his immigration status some years ago.
