Immigrant to enter POE before sponsor comes to the US

Hello,

Spouse has been issued an IR1 immigrant visa via DCF.

Plan to move to the US in July 2017.

 

Due to certain factors (kids pending school, orthodontics and what not) it would be convenient if the spouse (who just got the IR1) could travel to the US and begin to set up while the sponsor comes a month or two later with children.

 

On the other hand, i did read somewhere that the sponsor is supposed to either be present in the US or travel with the beneficiary while he/she immigrates.

 

This is a genuine situation and the sponsor will of course be travelling back to the US 2 months later...but has anyone any experience with such a situation or any references.

Yes, the law says the sponsor must get to the US first, or at least at the same time as the immigrant. I can imagine some scenarios where that isn't the most convenient situation, but the rules are the rules, and we have to follow them. I suppose, if money isn't too much of an object, the sponsor could go to the US with the immigrant, and then leave the immigrant in the US while they leave the country and then return a couple of months later...?

Your best option is to wait until the whole family can travel together and stay in the US.

The beneficiary cannot avail an immigration benefit until the sponsor has established domicile.
