Different petitioner for k1 but the same beneficiary

Hi, 
My ex have applied for k1visa back 2011. I didn't know if he withdraw the petition yet, but i saw him got married already in the US.
Now, i met my new fiancé and planning to apply for k1visa. Will my previous application affect the new application?
On the first k1, I never even reached to to interview, i never even gotten any email. But it already went to NVC and after that, we already lost our communication. Pls let me know what's the best thing to do and will it affect the new k1 application?

Hi @RedRina we have the same case, the difference was I went through the interview and I have been refused. Hope someone could help us about this!? For all of us deserves to be happy. Good luck to us!??

did u heard any story the same as mine?

idk if we should go ahead with the k1 application now. Coz I don't want to waste money and time and nothing will happen..

It's been 6 years since your first I-129F was filed for you. USCIS know life goes on and people meet new people.

 

I don't think it will cause you problems but yes it might come up doing your interview. By that means you might get some questions about it and then you just answer truthfully that that relationship unfortunately ended. They can see that the case didn't get to an interview or a issued visa.

The first K1 happened several years ago so you should be OK, but expect for it to come up on your interview.  Or you two can get married in the Philippines then apply for spousal visa

06/29/16: Response to RFE sent to CSC was received

07/05/16: I-129F was approved and sent to NVC

07/27/16: NVC received petition

07/28/16: NVC sent petition to US Embassy in Manila

08/01/16: Consulate received

08/30/16: Medical

09/13/16: Interview date / Approved

09/17/16: Visa in hand

12/29/16: POE - Dallas, TX

01/20/17: Marriage

Your ex-fiance needs to withdraw his I-129F petition.  If he does not withdraw his I-129F petition, the U.S. Embassy Manila will deny your current petition.  There are a few cases here on VJ where that has happened.

Hi @Tahoma,

i heard also some stories of what u said.

but most of the people told me that my case is different and the first petition has been filled 7years ago. And it didn't even went for interview stage. And im now living in UAE and the my second petition will be applied from here.

pls let me know if there is still a big risk of visa issues.

Hi @Tahoma I was refused on k1 before? That was way back 2013, we broke up already. Thank you.

There is a risk in Manila.  There is also a risk in the UAE.  Talk to a knowledgable immigration attorney.
