So I received my conditional green card last year Jan 2016 and around Sept of this year I will need to file my I-751. I am worried for two reasons, me and my husband ended up filing separately this year. He owes money to the tax department and for student loans and I did not want to pay his debt. Also the tax person did ours together and we ended up owing money to the government, where as if we filed separately we didn't owe nearly as much. Also we have our own bank accounts, we do have one together but we don't use it much. We used it a lot more before I got my green card, but since then my hubby has opened a new account. We both only have partial money going in there, not much at all. I know that we are meant to send proof of joint assets from when I got my conditional green card until we file for I-751 and I can send bank statements but there hasn't been much activity.  I have been reading that other people have sent statements for the full two years! We do also have a credit card together which we use a bit, but not all the time. We have utility bills, lease, health insurance, telephone bills, life insurance too. Can anyone offer advice on what to do? Will they question our bonafide marriage based on what I have just said? Any advice? I still have a bit of time to get things together but would rather do it sooner than later!!!

You mean you filed married but separately both years?

 It's ok to file separate provided you're filing as "married filing separate" and NOT single. Going to your I-751 evidence USCIS places strong emphasis on financial liabilities like bank accounts credit cards etc. Just gather as much evidence as you can to compensate for aspects lacking. The worse that could happen is you'll be sent an RFE asking for more evidence months ahead again down the road which you must've amassed by then. If it gets even further you'll be required to attend another interview which generally for most people is a breeze and finishes in a few mins. You want to gather dating back to marriage if you can and send those statements even if they have limited transactions provided they're joint. Also consider adding wills, medical power of attorney.

12/05/2017: Package delivered in Phoenix, AZ. Transferred to Harrisonburg Processing Center.

12/07/2017: Notice of action issued. (IOE)

12/26/2017: Biometrics.

01/23/2019: Interview Scheduled for 2/27/2019.

02/27/2019: Joint I-751/N-400 interview. N-400 recommended for approval.

05/16/2019: N-400 APPROVED! Placed in line for oath ceremony.

05/17/2019: Oath ceremony notice mailed.

I agree with Starkilla09's response.  You may want to check the I751 ROC forum as there are a couple of pinned threads regarding the evidence needed.  You will also want to include information,on any trips you have taken together, personal cards the two of you received from family and friends, insurance information as well as affidavits from people that have known both of you since you started the marriage.

 

You may also want to ask a moderator to move this question to the ROC forum to get more answers from those that have recently submitted packages.

Thanks, yes we filed our tax returns together the first year but filed them separate this year. I have plenty of cards for birthdays, valentines day, Christmas, anniversaries that we have given to each other plus envelopes from my mum which are addressed to both of us. I am on his life insurance and he is on mine. We haven't been on a vacation recently but will be going on one just before I need to send my paperwork in which is good.  I will just send the bank statements regardless, to be honest, in this day and age a lot of people do have separate bank accounts and I think that the USCIS would understand that. I really hope we will be ok!
