N-400 Evidence send them or not

Timeline

Some people do either way though many just send in the required stuff as instructed on N400 application, and bring all evidence to the interview in person.

Adjustment of Status From F-1 Visa.

8/14/2014: Mailed AOS package: I-130, I-485, I-765.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

10/01/2014: EAD mailed.

10/03/2014: Received EAD card.

10/14/2014: I-485 moved to testing and interview.

1/28/2015: Interview scheduled for 3/4/2015.

1/31/2015: Received interview notice.

3/4/2015: Interview completed and APPROVED!

3/5/2015: Welcome notice mailed and I-130 Approved.

3/10/2015: Welcome notice and I-130 approval notice received.

3/12/2015: Green card mailed.

3/14/2015: Green card delivered.

Removal of Conditions: 

12/14/2016: Mailed I-751.

12/19/2016: NOA issued.

01/26/2017: Biometrics.

05/03/2018: I-751 transfered to NBC.

02/27/2019: Joint I-751/N-400 Interview.

05/14/2019: I-751 APPROVED.

Naturalization:

12/02/2017: Mailed N 400 to Phoenix, AZ Lockbox. (I-751 still pending)

12/05/2017: Package delivered in Phoenix, AZ. Transferred to Harrisonburg Processing Center.

12/07/2017: Notice of action issued. (IOE)

12/26/2017: Biometrics.

01/23/2019: Interview Scheduled for 2/27/2019.

02/27/2019: Joint I-751/N-400 interview. N-400 recommended for approval.

05/16/2019: N-400 APPROVED! Placed in line for oath ceremony.

05/17/2019: Oath ceremony notice mailed.

06/12/2019: Swearing in Ceremony! Finally a U.S. citizen!

Timeline

if filling under the 3 year rule and in all interactions with USCIS the burden of proof is on the applicant, which means the applicant has to provide enough proof to justify eligibility - since this is a benefit allowed only to those married to a US citizen, the applicant has to send in proof of eligibility = proof of bona fide marriage to at least allow the application to go through and be accepted. As such, documentation has to be more extensive since it is an accelerated benefit by 2 years compared to the 5 yr rule.

Now this doesn't mean attaching everything to the N-400, but essential documents to determine eligibility under the bona fide marriage should be attached. Examples could be:

- Joint financial responsibility ( mortgage, loans, tax returns, bank accounts),

- joint life evidence ( children birth certificates, memberships, health benefits, 401K and other savings/investments beneficiaries listing both spouses)

If you don't want to weigh down the package you could organize it by area and provide the first page and make a note that the entire document can be provided during the interview. So instead of your entire mortgage contract, a copy of the first page, etc

  • 08/14/2007 Emailed choice of agent ...i'm so curious when they will accept it...hopefully soon

  • 08/21/2007 DS3032 and AOS fee bill arive in mail

  • 08/27/2007 paid AOS fee bill
  • 8/28/2007 DS3032 choice of agent accepted
  • 9/3/2007 IV fee bill generated

Here is the risk doing it at the interview, the IO could say he/she needs to go through the newly submitted evidence and therefore can't approve you on the spot. I have also seen cases in the past people only sent what's sufficient (usually 3 years of IRS transcripts), then they also didn't take any additional evidence to the interview and got RFE'd to submit more. Better to do it now than having to deal with later or getting delayed.

 

The only harm sending it at the time of application is the additional postage money, that's it.

 

I've send more than what's sufficient for N400 but less than what I've sent for my ROC (feel free to check my timeline for the list of evidences I've sent in both). I took a few more evidence to the interview that I haven't sent with the application just in case. No questions asked to show any marriage related documents except last year's tax transcripts. I already sent them with the original package but the IO said she didn't see them. I showed the copy I took with me and that was it.

Better to frontload all evidence that is applicable. The IO has time to review everything before the interview and not last-minute.
