K1 Visa and health insurance

My spouse has been here on a k1 visa since July 2016 we married in august and filed the adjustment of status and work permit a few months ago, I wanted to get him on my health insurance which I have through my employer, however when they tied to do it they needed to enter an SS number which we didn't get for him, we didn't realize we had a time limit to be able to process that when he first arrived, however some things I’ve read online suggest it may be possible for me to still add him but I'm trying to find out for sure before approaching my human resource person as I'm sure they will not be sure of it,  does anyone know if its legally possible to get my spouse on my health insurance in this sort of circumstance?

the ssn is not required for health insurance, and it is on you to know the rules unless they want to be nice and retroactively add him.

 

you have so far had 3 opportunities to add him and you chose not to.

1 when he arrived in the us, it is a change of residence which qualfies.

2 when you two married.

3 during open enrollment.

with out moving or changing jobs there really is no way to add him till he gets the greencard or the next open enrollment. a fault caused by hr preventing you from enrolling does not give you another try. I'm sorry.

I would go to the SS Office immediately and file for an SS# Better yet, fill out the form online at ssa.gov. The number comes within a week. With your HR policy I am not sure. Explain to them about your situation. Bear in mind the SS Number comes endorsed with a notation, Not Valid without DHS Approval. Did you apply for AOS together with a EAD/AP? 

 

You will need those or at least a NOA1 for the AOS

#1 likely wouldn't have worked for them because they were engaged, not married when he moved.

But I agree, yes that HR should have been able to add him without an SSN. There is a box for it, but it's not required.

 

 

OP: Talk to your HR people and see if there's anything that can be done, but know that it's not likely. You may want to investigate buying him an individual plan for this year, or until your next open season.

23 Dec 2015: Legal marriage

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. 16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

?? Aug 2015: Arrived at NVC

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

Timeline

You don't need his SSN to add him to your health insurance (although your health insurance provider will ask you for it for tax purposes at some point). His birth date is usually enough to set him up. You typically have only 30 days from the date of a life event (i.e. getting married would have been your life event). Otherwise you have to wait until open enrollment. So you can still add him. You just have to find out when your open enrollment is from your employer.

First thing you get on a K1 is  a SSN.

 

Health Insurance does not require a SSN.

if you did have treatments done during that time it would have been covered since they retroactively covered you

Thank you to everyone who responded.  My apologies if I posted in the wrong section.  I contacted the HR person in my company and they are looking into it.  The one thing I do have going for me is I work at a human resources company and its operated by good people and I know they will help me out if they can but I also know my case is the first time they had to process a spouse of an employee who is not a citizen without an SS number.  From my understanding once he gets his work permit which should been soon (its been about 90 days since we filed for it) he can apply for an SS number but I don't want to wait to get him insured if I can help it.
