Timeline

A person received his or her two years green card and want to get a divorce just because he or she doesn't want to stay married.  Will he or she able to get the permanent residency after divorce?

Wow, how wicked can a person be!! Using someone to get to the US for their own selfish reasons? Why didn't he/she start what they knew they couldn't finish!!? If someone knows that they do not plan to get married or stay married to their petitioner,please save the petitioner his/her time, money and heart aches.They should have applied for a different visa type e.g HB1 or went to the US as an entrepreneur.  According to my understanding, you cannot get permanent residence in such a case, unless divorce was led by physical or emotional abuse, domestic violence or when a petitioner neglects a beneficiary, if the petitioner is deceased or psycho or went to jail.

Yes with a divorce waiver, he or she will prove marriage was in good faith. Most of them got it by the way.

Can a divorce waiver kick into play with this kind of scenario?  Because I tried searching and found nothing related to this matter.

USCIS is not marriage police they don't care the reason for the divorce whether someone got fed up or whatever. What they actually care is if the marriage WAS originally entered in good faith and not to circumvent immigration laws to procure a green card. Not every divorce has a trail of big dramatic prequels, as some people can be unhappy and change their minds. Back to question yes a divorce waiver can still be successful and conditions removed, provided they can demonstrate marriage was entered in good faith ( with documentary bona fide evidence). The hard part is it can prove a little difficult to demonstrate if marriage was so short and lacks joint bonafides, however; it's not impossible like I mentioned.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

12/02/2017: Mailed N 400 to Phoenix, AZ Lockbox. (I-751 still pending)

12/05/2017: Package delivered in Phoenix, AZ. Transferred to Harrisonburg Processing Center.

12/07/2017: Notice of action issued. (IOE)

12/26/2017: Biometrics.

01/23/2019: Interview Scheduled for 2/27/2019.

02/27/2019: Joint I-751/N-400 interview. N-400 recommended for approval.

05/16/2019: N-400 APPROVED! Placed in line for oath ceremony.

05/17/2019: Oath ceremony notice mailed.

06/12/2019: Swearing in Ceremony! Finally a U.S. citizen!

The only set back is if the USC has convincing evidence that the marriage was fraudulent. If that is the case then there is a chance a beneficiary could be denied permanent residency.
