I was denied on k1 and met someone new

USCIS is all about transparency. So to be on the safe side, attach a statement in the packet explaining what happened. It would be better if it comes from you.

 

 Also, you are the beneficiary, withdrawal of the petition is the petitioner's responsibility and I am sure that not everyone goes through a good kind of breakup wherein the exes are still in speaking terms and USCIS sure as hell won't force you to talk to them again just to have it withdrawn. :) 

Yeah, we been looking for answers and this past few days I have received comments like what you have saying.?Have you been refused for a visa before or your on the process on waiting for noa2 when you broke up? where will be your interview? I am wishing you the best of luck!?

No I haven't been refused of a visa before. We have already  been approved, I have been here in the US for 3weeks now and getting married on Tuesday, filing for AOS by the end of this month. :)

Oh nice!? Glad to hear that. I will let you know!? Yeah, I am hoping that everything goes well too. Praying for the best!? I am just a beginner here and each day I am learning something about k1. (But sometimes it is confusing also because of different answers, lol) Glad I found vj.?

I was once like you, too. Being a regular here taught me a lot about the process and now I am reading about AOS, VJ is a big part of it. :)

I have learned about sending complete packet for we missed some of docs/files in our petition. Hope they will send us RFE soon.? We got our NOA last Feb 17th. How long is the whole process of your k1 if I may ask??

Timeline

Hi, my k1 case with my ex before was considered denied by uscis. He filed a notice of appeal but also they denied it. When i checked it online its says decision mailed. So i guess were okay, also rapid visa says shouldn't be a problem. I never made it to interview coz we been denied in documents..

Hello @keizynjohn2015? I've been refused and went to an interview, until now the status of our case is refused. Praying for the best for this. So far most of I had talked to says it won't affect my new petition.

The U.S. Embassy Manila has refused many K-1 visa applicants because of previous I-129F petitions which were not withdrawn.

 

To make sure you have no problem, your previous petitioner should withdraw his petition.  He's the only one who can do so.

If you never made it to the interview stage, that's okay. NOA2 has an expiry date and if the stages after that never happened until the date mentioned on the paper, then it becomes null and void. But if you have not sent your packet yet, better attach an extra sheet of paper along with the I-129F explaining about the previous petition filed for you and the details such as up to which stage did it reach.

Hello Tahoma! What do you suggest that these people do in order to have their exes withdraw the previous petition if they are no longer speaking with their exes? Calling USCIS won't help. As we both know, it is the petitioner's responsibility to withdraw the petition. What if the breakup was not good? How are they supposed to get in touch with them again and ask a favor like "Hey, my current fiance has filed for a k1 visa for me, I just need you to withdraw your previous petition of me so we can go on with our process." if the relationship's end was not good? Just asking. Maybe you have a suggestion you can give to these people on how they could have their exes withdraw the petition or make sure that it has been withdrawn. :) Thank you!

Hello Nickz1517 :) You have already reached to the interview stage and has been denied the visa years ago. It means they have already given you a decision that you cannot have it at that time because of reasons only you and the consul know. Sooo what I am saying is if you have already been given an answer before which was a NO, what else is there to withdraw? You have already reached the final stage of the K1 visa before which is the interview stage, it was just that the outcome of it was not what you were expecting that time. Idk if I am making any sense right now. I hope Tahome can shed a light on this matter. :)
