I was denied on k1 and met someone new

Timeline

Good day everyone! I had been denied 2013 on k1 visa interview because the consul think that my ex fiance can't support me. And they think I might be a public charge. Since then we broke up. Years passed and I met someone new, he filed a k1 visa petition for me again. Will I be denied because of my first petition? Some people said I should cancel the first petition before my fiance could file a k1 again. Called the us embassy in our country then said since I've been denied the case is closed. But I could send them an email just to make sure and I did it. But for some reason they replied on my email and said I can't cancel it, the petitioner is the only one who could cancel it. But I don't know where he is right now and we don't talk after we broke up. My fiance consult an immigration lawyer and he said no need to cancel it because there is already a rulling on my case. My fiance already filed a k1 visa for me again and we got noa1. I am still confused. Can anyone help me about this? Thank you.?

Hello @RedRina?.. I went for an interview and I was refused. Yeah, sometimes it makes me worried. I am thinking to get through a lot of questions from the CO. Hope everything goes well.??

Hello, we just received our noa last feb 17th. I did. I even called the us embassy because someone I knew did it before. They said I have to cancel it. I talked to their customer care or csr about it and she said no need to cancel it because I have been refused. But just to be sure she advised me to send them an email and thats what I did, they responded but they said I can't cancel it. Only the petitioner could do it. So I am confused about it.

Now that I've read here stories about being denied/refused because of multiple petition in one beneficiary it makes me even more nervous. My ex and I had a bad break up.? It cross my mind that I might be denied again. I hope and pray that it won't affect my petition. What is your story?

It shouldn't be an issue with you being a beneficiary but it would be an issue with your ex if he ever files for a new K1 visa for someone else because the sole responsibility of withdrawing the petition is the petitioner's. not the beneficiary's. Also, in the forms that needs to be filled out for the K1 Visa process (I cannot remember which form), there is a part there that asks the petitioner if he ever filed for a petition previously, so clearly, previous petitions are the petitioner's problem, not yours. :) 

 

But to be on the safe side, I would recommend you to attach a separate sheet of paper disclosing that there was a petition filed for you years ago and the details of it (as far as you can remember) and include it in the packet that your fiance will submit. You can mention your ex's name, what stage did it reach to, when was it filed and when did the interview happen and other details you may have (if you still have it) such as case #.

But I am hoping and praying that it really won't really affect our petition.?? I know they will ask it on the embassy but I aam considering it. Have you heard of same kind of case like I have??

I am in speaking terms with RedRina and discussed the same thing with her the other day. I ask a very well-informed person about it, his experience of 13yrs and helping people in visa-related issues convinced me of his answer and he told me that there is no possibility of it affecting your new petition whatsoever as long as you will be transparent about it and would admit to it before they even find out. USCIS is all about transparency. So to be on the safe side, attach a statement in the packet explaining what happened. It would be better if it comes from you.

 

 Also, you are the beneficiary, withdrawal of the petition is the petitioner's responsibility and I am sure that not everyone goes through a good kind of breakup wherein the exes are still in speaking terms and USCIS sure as hell won't force you to talk to them again just to have it withdrawn. :)
