2017 Checklist for CR-1/IR-1 Spouse (I-130)

USCIS is requiring, effective April 28, 2017, that the new 2017 version of I-130 be used:

February 27, 2017

Update to Form I-130, Petition for Alien Relative New edition dated 2/27/17.  Starting 04/28/17, USCIS will only accept the 02/27/17 edition. Until then, you can use the 12/23/16 edition. Now also available, new Form I-130A, Supplemental Information for Spouse Beneficiary.

Most of the guides and guidance (on this website and others) obviously relate to the 2016 edition of the form.  Does anyone know what must be included for a CR-1 petition for foreign spouse via the new I-130?

 

For sure:

1. I-130 (2/27/17 edition)
2. Form I-130A, Supplemental Information for Spouse Beneficiary
3. Form G-1145, E-Notification of Application/Petition Acceptance (optional)
4. Civil marriage certificate and copies of prior marriage termination
5. Documents to show U.S. Citizen/legal permanent resident status (e.g., birth certificate or passport)
6. 2 passport photos of petitioner and spouse-beneficiary
7. Documents showing bona fide marriage (lease, joint ownership, affidavits, photos, etc.)
8. Filing fee

 

Is that it?

 

With the 2016 I-130, you also had to submit Form G-325A, Biographic Information for petitioner and spouse-beneficiary:

• If you are using the 12/23/16 edition of Form I-130 to file for your spouse, you must also submit two Form G-325A, Biographic Information: one for you and one for your spouse. Do not submit Form G-325.

It is unclear if G-325A is also required with the 2017 I-130, because the USCIS website further down then says:

• If you are filing for your spouse, your petition must be accompanied by a Biographical Form G-325A for you and one for your spouse (not form G-325).

You file the G 325a if you are filing using the old form.  The new form includes that information. The old form was 2 pages without the G 325a.  The new form is 12 pages.

That's my thought too.

 

Then is my checklist above all I need?  I thought there'd be more I guess, but this seems consistent with what was required under the 2016 I-130

Just curious -

 

Do we still need to do a 325A if we are filing the 485 concurrently? I noticed it does show in these directions, but looks like just the beneficiary needs one then and not both or can we entirely not send a 325A with the packet if we are filing them all at once?
