Hi everyone,

I am a filipina who was once married in the Philippines to a foreigner. Unfortunately it didnt last. He filed divorce in his home country and I have a copy of the divorce decree but I havent had it recognized in a Philippine court yet. Now my fiance wants to file for a K1 visa, am I qualified to apply for it without having my divorce recognize in Philippine court? Please help.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes.  Your fiance will need a copy of the divorce decree to include with the I-129F.

 

I would suggest you complete the recognition process while you have time also.  Makes life easier later on.

In the future you will want your passport in your NEW married name?  Or file Report of Marriage with your new husband.

 

Can't do that without the divorce recognized.

Visa chase and citizenship.. DONE!

Timeline

Since your divorce happened in your ex home country, you have to take your divorce decree to DFA, authenticate it there and take it to NSO after. NSO will then give you your marriage certicate with a stamp stating your marriage is now null and divorced.

- Did you file for judicial recognition of your divorce in a Philippine court before taking the divorce decree to DFA?

I dont remember going to court. I believe it was authenticated in the canadian embassy, since my ex is canadian and he file the divorce documents in canada. Then I took it to DFA, in Manila tho. I am from Davao. Then take the Auntheticated document from DFA to NSO Main office in Manila. This all happened a few days before my US embassy interview for K1 Visa. The US Embassy, recognize my divorce even if I was married in the Philippines.

I am in the same situation as you when we applied for my k1 visa but I didn't get any problem about it to get my visa. Just get a copy of your divorce and show it to the embassy and you will be fine. I'm already here in the states since 2015 and already a GC holder. Im still married in Phils with my ex and its  expensive to file annulment in there, I wish I know other ways how to get it change.

12/31/2014: Received Electronic notification for NOA1 hard copy to follow

01/05/2015: NOA1 Hard copy received

01/13/2015: Received Electronic notification for NOA2 hard copy to follow

01/20/2015: NVC Received

01/26/2015: Case # assigned

01/30/2015: Sent to embassy

02/02/2015: Embassy received

02/08/2015: Interview Scheduled for 03/11/2015 Will do Medical on 02/26/2015

02/23/2015: NVC Letter received.

02/27/2015: Medical complete.

03/11/2015: Interview. APPROVED!!!!

04/03/2015: POE Seattle

06/20/2015: Got married

Thank you AmerFila. Me and my fiance are quiet nervous about all these. In K1 visa he will do the initial application in his place with all my needed documents attached including my divorce decree, right? Maybe then USCIS won't approve his application if they find it invalid right? Then we dont have to proceed and saves us from suppose to be more expenses (medical, interview, etc.)

As long as you are both free to marry (include copies of divorce decree(s), have met in person within the past 2 years from filing the I-129F and provide all other required evidence you shouldn't have an issue with USCIS.

 

I know of many that were divorced in another county, yet still shown married in the Philippines, and got their visa.
