Hi everyone,

 

It is currently the 90 day period to file ROC for my spouse, and since receiving her conditional 2 year green card we have moved to a new address so some of our documents still use our old address. For documents like these (that many posters here state they have sent) is it still advised to send them in as evidence? 

 

First example: both of our driver licenses show the same address, but its our old address, not our current address. My DL renewal came last December, so I renewed and it reflects our current address now, but it is impossible for my wife's DL to show our current address, since the drivers license my spouse applied for 2 years ago coincidentally also expires the same day her green card expires, and from my researching online it appears she cannot renew her DL anyway without applying for ROC first. She has updated her record online with DMV to our current address though. So in this case should I still send a copy of both of our DL's at our old address (her valid DL and my expired DL)? or should I send her DL with old address and my new DL with current address? Or just not send at all?

 

Second example: my spouse used to work and received a W-2 for 2016 but the address on file was our old address, while my 2016 w-2 has already been updated to our new address. The only way for us to show any tax documents both with our current address would be my w-2 and a 1099-int she received for some interest. So should I send my w-2 and her 1099-int with our current address, or not send at all?

Assuming you've both filed change of address forms with USCIS (AR-11 for the immigrant, I-865 for sponsor) then USCIS has both addresses so it's clear that you're still living together. Generally, the wisest thing to do is enclose everything. If you're making a cover letter, you could mention it (for example: bank statement (former address), driver's license (with new address), etc) You could even include that info in the body of your cover letter ("We have recently moved together to our new home....")

It shouldn't be a problem. Lots of people have this issue when they move. I'm sure it's nothing USCIS hasn't seen before. You might want to prepare your taxes now and send copies of everything with your application - the fact that you're filing jointly, from the same address will certainly help clarify things.
