HELLO EVERYONE 

 

first of all thank you for all the wonderful information which is posted on this website, i have been trying to find my answers but unfortunately my case is some what unique so i am reaching out to you in order to get better guidance on this situation:

 

I am a us Citizen and have recently married for the first time a Canadian citizen who is currently staying in the here in USA.  I am in the process of filling out his I-130, I485, I765 forms but i have a few dilemmas due to our cultural pressure.

 

We are currently not living together because culture does not permit us to live together until we actually have a wedding, a date has been set for later this year and all the necessary wedding planning are booked ( hall, photography,  decorator etc.). 

 

my question is as follows: since we do not live together, what addresses should i put on the i-130 forum, i485 and all other forums.?  would putting his physical address as different than mine cause an issue, we intend to live together after were married but as of right now we are not even thought we see each other frequently,

 

when he entered the US, he was inspected at the borders but was never issued an i-94 or a visa number because he is a Canadian citizen so will this make matters more complicated for us?

Are you legally married? Do you have a marriage certificate? Because if not you can't file an I485 for a spouse because he is not your spouse as of now. 

I you are legally married than thats a different situation.

 

In my opinion wait until you live together than file. Because in the interview you will be asked if you live together or not and lying to an officer is bad.

we are legally married and have been for 3 months, i do have a marriage certificate on hand, the reason why i would like to submit his application is to have him apply for a job and to begin looking for a place to furnish for us to stay in, as of now we are both staying with family.

If you're legally married, what is the family problem about? You're married. Act like it and move on with your life.

I know a few Canadians and had not heard of this, but you say you are Married so not sure what the issue is.

originally we are Muslims, and as Muslims, we cant live together until we do the wedding, that is the dilemma, that were in, so until the wedding day, me and my husband are living at our parents homes, after the wedding we are moving in together, so my question is as follows do i put all the address on the i130, 1485, i765, i864 as my address and as if hes living with me? or do i put his actual physical address?  he is living in a different state im in IL, and hes in Alabama, but he plans to move here soon to find work after he gets his I-765 approved, so what do you guys recommend i do about our address, place it all as 1 address or separate our address and provide a letter to explain the situation?

File when you marry and are cohabitating. If he wants to work then head back to Canada and he can work until he immigrates.

If he returns to Canada, file for spousal visa as he should not re-enter with intent to immigrate.

 

Either move in together and file at same address or like Boiler said, have him return to Canada for awhile and keep working while you do a spousal visa process.

Huh? This is confusing. Are you married, or not?  

Is it a marriage for immigration but not for family?

Like OP said, they are muslims. .and as per muslim religious practice even if they are married legally ( in the eyes of the law, with a marriage certificate etc) they can't co-habit until they are religious ritual takes place. Islam prohibits co-habitation until y religious ritual is complete.

if you knew you had this problem, they why wouldnt u just marry religiously and then do the CR1?? people want to always cut corners and are not prepared with. teh consequesnes!  

 

yes, you will have problems not living together... to the eyes of the government you arent married!!!! get married in your traditional religious ceremony, then have him move in and then file for the greencard.. whether he wants to stay here and wait until then or go back to canada nd plly for the cr1 is up to you.

Doesn't matter if you live with each other or not. Just start filing and put all of the pictures and texts and communications you have. Don't waste the time. It is a long process around a year. Remember if he is there with the Canadian passport and leave the US he cannot come back as when you are married you can not enter with the visa and they need immigration visa. Although all from my experience ...

He can not immigrate without an immigrant visa, he can visit.
