Hello, I do have a quick question.  My husbands coworker has working papers, a social, and has been here in the us since 5.  He apparently never had a visa.  His family came over from mexico. I'm not clear on how he was able to do school and has working papers.  Apparently he has to renew it every two years.  The company he works for refuses to file for him.  He told my husband he will try to adjust.  But what can be done here?  He's such a good kid, and he takes good care of his siblings... would be hard to see them uprooted.  He pays taxes too and is in the process of buying a house.

It's called DACA, and I don't think the person needs an employer to renew anything. It may be a lot easier if the employer fills out and renews for him but it is surely do able to renew DACA just on your own last I checked.

No idea. Depends on a lot of things. If he is married to a citizen and if he managed to enter with inspection it's easy. If he says he can he probably can, just tell him to get a lawyer to assist him so he doesn't have any snags down the road.

Oh alright.  Not married.. he's such a shy kid.. (he's in his twenties)... but my husband thinks he came over illegally or assumed he never had a visa.. I guess I will try to talk to him and then tell him he would need a lawyer since it would be difficult.. *shrugs*  he would have received DACA initially if he went through inspection right?

no, DACA was signed by President Obama in 2012, so this is quite new, children who entered the country under 16 and by mid 2007, could get a work permit that had to be renewed every 2 years, but it has no path to adjust status, it's a temporary status

 

But he can get a GC through a USC, just not directly

I could be wrong but pretty sure entry without inspection can still get DACA. If I am wrong, someone on here will correct me. 

 

There also may be other ways to adjust like employee sponsors, but I literally don't know a thing about that process.

So he can't apply for the daca i imagine?  I dont understand because he went to school here, graduated here.. came over as a child.. is able to work, pays taxes...

as said, he has DACA, he is legally in the country because he already has DACA

 

but since this is a temporary status, like TPS for certain countries (temporary protective status) there is no way to adjust unless he is married to a USC and he would have to take certain steps, because there is no direct pathway to adjusting status in the US

Yes he just confirmed having DACA... well this saved him from going to a lawyer... because he wanted to see one about adjusting his status.... Thank you for the responses and the information

unfortunately, there is no way for adjusting status directly

 

DACA doesn't have a direct pathway for adjusting status, just renewing every time he needs to.

He does not have any Status to adjust from. And no way of doing so, better get him on match.com he needs a US Citizen GF, or BF if he swings that way.

daca does not provide legal status It simply gives him a temporary delay in being deported and the a ability work and get a ssn. it expires every 2 years so it has to be renewed if he is still qualfies. keep in mind it was created by executive order so trump can remove it at any time.

 

you can get daca by overstaying a visa or crossing illegally the latter making him unable to adjust to any legal status while still in the country.
