Hey, i was wondering if i could get some help with the I 864 affidavit. We're working on our AOS application now. I will be sponsoring my husband but i know i will need a joint sponsor. His brother is willing to be the joint sponsor, so he fills out another I 864, right? Here's the confusing part, we're living with his brother, so do him and his wife need to fill out the addendum to the I 864??? (The one that's for people you live with?) Will only he need to fill it out or will his wife? Also, we haven't been living with them for more than 6 months, the application says thats a requirement....

Any :help: is appreciated

also...the last 3 years' tax returns i didn't file independently, i was claimed as a dependent by my father, do i include them?

Lots of questions! I'll try to answer them as best as I can. :) First of all, good job on getting the AOS together and may it be a smooth and non-stressful experience for you.

(1) Your brother-in-law needs to fill out a separate I-864 and to include all evidence for it (IE: pay stubs, tax transcripts, proof of citizenship [birth certificate, etc.]). He then needs to get it signed and notarized.

(2) I don't know if your husband/wife need to fill out the I-864 addendum, alas. If you haven't lived there for six months, I'm inclined to say that you wouldn't need it.

(3) Even if you didn't file independently, it's a good idea to get a copy of the tax returns. Just call the IRS to ask for copies of your tax transcripts.

(4) The A# should be listed on any documentation that you've already received from USCIS (like K1 visa). If you don't have that, then your husband's visa(s) might include it. The I-94 oughta have it, but if that isn't the case, and you cannot see where he was issued one for whatever reason (like he's a Canadian who entered across the border as a visitor; they aren't issued A #s) then put "None" on the application.

Isnt it the i-134 that the BIL needs to fil out ?

If there is a co-sponsor for the I-864, the instructions state how to submit it along with the AOS package. It calls for providing proof of citizenship, proof of employment and income evidence. These are all listed out up front, pretty straightforward. :)
