Hello,

My husbands 601 waiver was approved in December he had his 2nd interview for ir1 visa was jan.23 2017 which the officer said she needed more time to process his case and gave him a 221g and his passport back and didn't ask for any additional documents.  On March 7th 2017 we recieved another 221g asking him to please submit his passport. Has anyone had this happen? If so can someone please give me some insight on the situation? Attached below is the letter he recieved.

If they want his passport back, I'd assume that be a good thing.

I didn't get one nor do I know what your letter means, but I would assume them wanting his passport back is a good thing.

The only rational reason to ask for the passport is to print a visa in it.

That's what I'm hoping I've seen people say they ask to do additional processing which makes no since as they have access to see if you ever traveled anywhere by flight.

My wife was interviewed on December 22, 2016 for CR-1 visa at New Delhi, India. Her case was put on AP and since then there is not even update online about her case nor we heard anything. She was not asked to submit any documents. I recently wrote to US embassy in Delhi to inquire about her case wherein we are told that her case is continued to be on AP and don't know when processing would be completed. So its going to be 4 months now and not even one update online...

Seems like a long while to wait they usually say resloved in 90 days. I would see about getting your lawyer or congressman involved.

Resolving an issue on AP depends on the merit of the case. So the length to AP depends on how long it would take for them to resolve the issue. The truth is- there is no any timeframe when it comes to AP. Involving a lawyer or congressmen don't do much either because all we will get is a typical response stating that the case is under AP...That's all. There is nothing you could do except just wait....
