Glad it got sorted in time. Hopefully your case is moving forward smoothly from here on out.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

I knew what was the RFE was for (missing a checked box on page 5) and the congresswoman's office requested I send them that page, with the corrections made.  They sent in that page and with permission from the congressional supervisor (who or whatever that is), USCIS accepted the missing document to be interfiled.  The interfiling of this document does not guarantee acceptance but shows that an attempt was made to reply BEFORE my time to reply expired. I was also told that I needed to respond to the RFE immediately and contact the congresswoman's office with the date I re-filed and with proof of mailing (tracking number).   My deadline is not necessarily extended but with the "congressional intervention", and my new RFE postmarked today (March 10, 2017, and going overnight to them...the priority mail option does deliveries 7 days a week, even to PO boxes), my case will be able to move forward (with 99.9% certainty).  

 

The reason I am sharing this is because, when I reached out on Visa Journey for help, my posting had over 200 views and not a single response.  I am not placing blame, as I assume 100% responsibility for my case, but I was hoping that by posting this, I could help alleviate someone else of the stress and heartache that we endured over the past 3 months.  

 

I do feel I have to mention that this service is only when you have tried everything in your power.  Do not call your congressperson just because you do not want to wait and you want your case rushed....they will not do it for those reasons...Remember...USCIS has everything documented...date your application was sent, date your RFE was sent to you and date you are to respond by.  If USCIS feels you are not in dire need, you will get nowhere. DO NOT LIE FOR ANY REASON!!!   With all of my documentation regarding the dates and times of phone calls, copied emails and proof on my "my uscis" account of the service requests I had sent and my deadline to respond approaching quickly, they intervened.  I wouldn't recommend waiting like I did...I had no idea if it was too late.  However, in my defense, I did not know contacting my congress person was an option until way late in the process.  Once I discovered it was, I jumped on it immediately.

I really appreciate your posting. I want to know if you made a mistake during your application peocess that need to warrant you to get RFE or why do you need to received RFE? I really want know because my wife made mistakes about my application to NVC, and they are now saying that we will receive email through them soon for additional documents.

I really appreciate your posting. I want to know if you made a mistake during your application peocess that need to warrant you to get RFE or why do you need to received RFE? I really want know because my wife made mistakes about my application to NVC, and they are now saying that we will receive email through them soon for additional documents

I did make a mistake.  My RFE was because I forgot to check a box on page 5.  Just so you know, they do not email any documents to us.  Everything comes through a hard copy in the mail.

Glad to hear you got the issue resolved.  Praying for your approval and then off to CDJ.  My wife went through CDJ a few years ago so let me know if you have any questions.  Mind you some processes might have changed in the last few years but I will help where I can.

NVC does send you detailed emails, whereas USCIS does not. Also, you can send additional documents to NVC even after you have sent in your AOS and IV packages (no guarantee that the additional documents will find their way to original package; and you may still receive RFE), but USCIS doesn't accept additional documents without the RFE face sheet and they will just throw away the mail. So you need to wait for RFE at USCIS stage even if you know what the mistake was beforehand.

Thank you once again. Our case is already at the NVC stage since 10weeks now. My wife was told during the phone conversation that they will send an email for requesting additional documents soon, which they never mentioned to her. I just hope that it won't be another stressful step again. We waited for long already for NVC.
