Need help to file for Dutch passport

Hello,

 

Me and my fiance are planning to file for the i130 and i486 but I came here in 2010 on a i94 (Esta waiver) that's now expired. My passport expired in 2014 and I've been trying to renew it. The Dutch embassy said the only way for me to renew it is to get an certification of Nonexistence but I read that you only are able to file for this when you passed away. What can I do since I can't file for the i130 without a valid passport???

Some Countries will only issue a transport documentation to get you home and not a passport.

I got told I need a valid passport or ID for the Bio

April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

"I got told" - who told you?  Also, looks like you can get an National ID card from your closest consulate, I would work on that. 

Uscis website and several lawyers. I can't get an dutch ID or passport unless I have a certification of non existence

Besides getting a lawyer in the US, becasue you are a illegal and they dont look kind on that at the momnet. maybe you can also get a dutch lawyer to try and get a pasport, dutch rules are very strikt on getting pasports. There might be exeptions but i had trouble getting a pasport last year even though i still lived in the netherlands but when you leave the country for more then 6 months and or not a regestred burger in a gemeente with a extual adres, you cant just get a pasport. you ahve to proof you live in the Netherlands 1st, for me that was simple becasue i stil ahve a house in NL and had not left for more then 6 moths but just on teh suspicion i had been gone for  monts i had to go to the geneentehuis and proof wth tikets and bills that i was still living in NL they dit an ivasecation and after a month or so I could appay for my pasport.
