I-864 question - Primary Sponsor has no income - already have joint sponsor

Hello VJ'ers,

 

My wife and I are currently going through the AOS process and we have a few questions about the I-864.

My wife has no income as she is a full-time student. Her father is helping us out as a joint sponsor.

For my wife's application we need to prove that she has no income. Now we have requested transcripts from the IRS that state that she has no income, but so far they haven't come in. Can we prove that she has no income by showing her school registration and class schedule? This should show that she has no time for a job.

 

For her father we filled in a completely separate I-864 instead of the I-864A form. The reason for this is that we thought that since my wife has no income there would be nothing to "combine". Is the I-864 form the right form in this case?

Timeline

If she doesn't have tax transcript because she didn't file a tax return, she would need to prove that it wasn't required. YOU could prove that by showing her income is below than the income requirement for tax filing by IRS.
