B1/B2 Visa rejected twice

Hi everyone, 

 

I am a doctor and live in Pakistan. I've booked my exam date (paid 1550$ fee). I didn't have sufficient account balance and my sponsor was my family friend (not even my relative). Visa interviewer kept on asking "why your friend is paying for you" and I couldn't convince him/her.

Later on, I put money to my account and applied again, but rejected again as interviewer asked "why last time you said your friend is sponsoring you".

I don't know how to get through this now. Need help because I have to take this exam to complete my ECFMG CERTIFICATION. Thank you.

you may have to wait until you get your spousal visa to take your American boards... As advised in your other thread, it's practically impossible to get a visitor's visa if you are married/engaged to a USC.

You biggest mistake as you can tell by the questioning of the CO was having a sponsor.

 

THERE IS NO SPONSORSHIP OF A VISITOR VISA. Just like the Co asked, "why do you need someone to pay for you?" Putting large sums of money in your account is also a red flag. From the eyes of the CO you cannot provide for yourself and need help from a relative in the US. If that is the case then you are a high risk of not returning to your country and staying in the US.

 

You were supposed to show that you have your OWN ties to your country. By your relative helping you so much you are showing ties to the US.

 

ETA: Also, didn't know you have a petition open already. So you have immigrant intent. That is another case against giving you a tourist visa.

What's to prevent overstaying.. and AOS.. on a B2? Soon-to-be wife is a USC. 

 

Unlikely to get a b1b2. Get married, then wife petitions for a CR1 visa

Case by case basis I guess. Got rejected in Oct '16 for a visit visa when i wanted to go to Vegas..got married to USC in my home country in Jan '17, reapplied for B2 in Feb and got it in a few mins. The lady asked me why I wasn't doing the immigration route..told her the tax laws suck in US and I take care of my parents, maybe will think about immigration a few years down the line...for now we'll each be travelling back and forth every few months. She said show me marriage cert and then goes I wish I was your travel agent, u guys gonna be racking up a bunch of flyer miles :D

if you just want to visit the us but not live there. go for the spousal visa and once you get it travel to the us do your sight seeing then return to your home country and surrender your residency. then aply for visitor visa. this will show them that you have no immigrant intent since given the ability you chose to return home even though you could have stayed legally.

why would anyone want to do that? A spousal visa is much more expensive and takes longer than a visitor visa...

 

I think the difference between guidinggod and OP is probably that OP wants to take their American board exams - showing intention to move to the US permanently and be a practicing physician there, whereas guidinggod has no intention to immigrate to the US, at least for now, and was able to show sufficient ties.

Because sometimes it can be the only way for someone to prove they don't have immigrant intent.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process
