Hi... 

My history is I came to USA in 2005 from Mexico without visa the immigration catch me they took my passport, fingerprints and personal information, after 24 hours they give me a letter that I have a court 6 months later but I never show because I was afraid they send me back to brasil. I lived in USA from 2005 till 2012 and I never have any other problem with police. In 2014 I have a baby from my boyfriend american citizen and he stay with us from 2014 till August 2016 and we got married in brasil in July 2014. He applied i130 for me and our son they approval us now are process is in Nvc we send the final package we are waiting for additional information our the date for interview. My question is they will ask me for a waiver? When they will ask? I have to tell then that I lived illegal in USA like send some report? Some articles I read that they know everything what we did in USA I send my criminal report from brasil it's all clear. Someone told me they will ask me for waiver on interview and I think maybe I can send a waiver before interview, another person told me they will give a visa for our son first and I will to stay here without my son and my husband... We are doing are process without a lawyer. I read some where I have to send a FOIA for they. I am very lost...

   When you didn't show did they issue a deportation order ?   Yes they know you were in the US  and you should never lie to immigration as it makes matters worse.  Right now you seem to have wavierable offenses  but you could get a lifetime ban if you lie. 

This will not be over quickly. You will not enjoy this.

What point I said I lie? I never lie for them... I don't know if know when I fill the form i130 I sad I entered without a visa and I did not show in a court... Dont say things you don't know I have a 2 years old son hows really miss him father I will never lie... Have a good day

You were obviously deported in Abscentia (your husband should get an atty)

The I 130 does ak about living in the US before, ans why is the baby requiring a

visa? dad is USC....also was the baby born in US.

 

This will not be a DIY case...be prepared to prove when you returned to Brazil,

and that you stayed there.
