Apply for Advance Parole after receiving EAD

I applied for an I-130 and I-485 in September last year. At that time I did not apply for an Advanced Parole. I got my EAD card but my application is still pending. At that time I didnt forsee any international travel and it seemed that citizen spousal green cards were being issues in a reasonable time. However I have a trip coming up in the summer.

 

I am wondering can I apply for advance parole (I-131) or it has to be applied concurrently with 785? Is there a way I can travel or am I stuck while the case is pending?

Yes, you can file for AP now. It is also free since you submitted AOS....include the NOA1 with your submission. ETA: ~90 days.

 

You cannot leave the US until AP is approved. Otherwise you will abandon the AOS application and likely be unable to re-enter the US without a spousal visa.

9/5/18: Interview scheduled notice, 10/17/18: Interview

10/24/18: Green card produced notice, 10/25/18: Formal approval, 10/31/18: Green card received

5/1/2017: Case received by Manila (1 week embassy transfer??? Lucky~)

7/13/2017: Interview: APPROVED!!!

7/19/2017: Visa in hand

8/15/2017: POE

Yep! And if you've got a good reason, they might even expedite AP for you. It won't be an EAD/AP combo card, but instead you'll receive the AP as a separate form that you can use for re-entry to the United States.
