Hello everybody, I got married on January 21st, 2007. I applied for I-129F and now the case is pending at CSC. I am trying to do the I-134. I am full time student , so i donot have any come. Can my father give the affidavit of support for my husband? He is a green-card holder. Do i need to do two I-134 forms, one by me and one by my father or just the one from my father?? Thank you very much for your help.

Check out http://mumbai.usconsulate.gov/ivforms.html. Click on "Instruction package for K-3 visa applicants" Then read the section "Affidavit of Support".

It says, you have to submit your form and if your income isn't enough, then you must submit a co-sponsor's (your father's) I-134. Not only that, but you have to submit everything listed under that section in the PDF file.

So, one of each of the following for you and your father:

-Form I-134.

-Documentary evidence that the petitioner/joint sponsor is a U.S.citizen /U.S.

permanent resident (e.g. clear photocopy of birth certificate / certificate of

naturalization / U.S. passport / both sides of green card, as applicable).

-Federal tax returns (form 1040) with all supporting schedules for the most recent

taxable year from the date of interview. An applicant applying in May 2006 should

provide a 1040 form for 2005. Failure to provide a 1040 form for the most recent

taxable year could delay your application.

-W-2 form for the most recent taxable year, if applicable.

-Job letter or pay stubs (should be less than 12 months old on the day of the visa

interview).

-Bank letter (should be less than 12 months old on the day of the visa interview).

-If self-employed include self-employment schedules filed with income tax returns or

financial records such as a bank statement for the business accounts.

-If the petitioner did not file a tax return, the applicant should submit a written

explanation from the petitioner explaining why he/she had no legal duty to file the

return.

-If the petitioner filed a late or amended tax return, he/she should submit evidence of

this.

-If the petitioner does not have copies of his/her tax returns, an Internal Revenue

Service (IRS) summary of this should be submitted.

Submit one from each of you. You may face a somewhat different issue when you file to adjust status. I'm not certain a green card holder is sufficient as an I-864 co-sponsor. You'll need the answer to that question too.
