N-400 Filers who got stuck or delayed in Background / Name Check.

Timeline

I've filed on March 2017 and had my bio metrics appointment on April 18th. and till now not in line for interview and my case is also pending FBI Name Check.

My field office already working on cases after my date now.

I've made two infopasses, calls in every month, following up with the congressman and filed with the ombudsman office. all of this didn't do anything. :(

I really don't know what else i can do.

Any recommendations ?

Those are the processing dates for Cleveland OH . Right now they are processing April 22, 2017 files. You are March. Have you ever tried to contact  USCIS online here

Yes, i did filed a service request and haven't got an answer on the date that they said they will reply by.

Its the same situation with me its been 15months , still background check pending. contacted usics, service requests, info pass, senator office, ombudsman & fbi

they say its in que sometimes, or workload, elis issues, etc etc.

don't know what else can I do besides waiting, because I don't think WOM will help since background/security check not complete

It will. WOM almost always helps, no matter what is the internal USCIS reason (unless the applicant has some dirty stuff on his record). The only reason people do not do it routinely is the cost (around $5000). See e.g. here: https://www.youtube.com/watch?v=lYl7XBVqc_E

I know, but I did read in some attorney website that they cannot have USCIS make a decision through WOM until the background check is completed which is done by FBI on which they do not have control.

You're not alone in Cleveland, OH local FO with a delay process.  I filed Jan. 25 and still waiting and hoping for an interview letter to arrive.  I've done few 2 SR online about my case because it's more than 90 days outside the Cleveland FO processing time but nothing's working no response from them.  This delay has been causing me an intense depression seriously.  2 out of 10 around my batch of cases have still FP online status and I'm 1 of the 2, the rest are already in-line for oath this month. It's more than 10 months already on my case and still hoping for an interview letter. :(

If they have these inconsistency of reasons when you inquired from them several times, it seems like they're lying.  This is one thing, I don't like about them they're not very upfront with the real reason of the delay.  It could have been good if they will tell upfront for the real reason so maybe applicant can explain if they find some questions on the record. I feel you, I'm sorry to hear for that 15 months of waiting, to me it seems unjustifiable.

Let me share with you this. I'm the original poster of this thread. Meaning I had been stuck in background/ name check for a long time just like you. I did research and tried a lot of things to push my case forward too. Unfortunately, nothing worked. It's hard to accept this but if you are stuck, that means you are stuck, you can't do anything until the FBI finish their job. I guarantee with you that no matter what you try, it's not gonna work, so don't waste your time.

 

Here is the truth, there are only 2 scenarios here:

1. If you are stuck, and have not been stuck for a year (count from the date you submitted your application). So you are fine, nothing you can do but wait. Your case is gonna be automatically cleared when it approaches 1 year. This happened to most of cases ( > 90% )

2. If you have been stuck for more than a year. Meaning you are so unlucky and having 2 options:

----- Continue waiting until the case cleared. Nothing guarantees when it occurs, normally 1.5 years to 8 years, or more, this is what a USCIS officer told me when I had my infopass.

----- Take your action: file a lawsuit against USCIS . This works most of the time and really push your case forward by forcing USCIS to pay attention to you. But this does cost money. According to people who recently filed the lawsuit, they spent around 3k upto 7k for a lawyer to do this.

Thank you for sharing your thoughts. I've been stuck in the background check for 8 months and very much agree what you said. We have got congressman/US representative/military to intervene and nothing works. What makes it worse is that I have I-751 pending as well. I really hope we will hear something by the end of the 1-year mark.

I'd agree on this.  I know this is a serious issue on their system's end, but for a laugh we can only blame our parents/spouses for us having common names :jest::jest::jest:  because this is basically what's causing the delay when there's no questionnable records...My relative got her bc done quick and naturalization in 4 months...LOng time ago she's bitching about her name because it doesn't sound attractive, but I told her "you know what, it may sound so old unfamiliar unattractive but give thanks to your parents because it's very uncommon and any USCIS petition you've submitted it's just fly quickly like a skyrocket within 3-4 months and it's done.  Uncommon names make it pass through quickly because no hits on it in BC unless you have questionnable records".

When you went to Cleveland for your infopass case-follow up, what did the officer tell you?  I'm curious, since my local office is Cleveland as well. I'm a January filer and after FP in February it's complete silence.
