Hi All,

 

My fiance and I are about to submit our I-129F but I have a few questions about the process afterwards.  A little context: we are both staying in Uganda currently on tourist visas.  She is from Ghana and has been unemployed for a few months.  I also have been unemployed and traveling or working low paying jobs.

  1. What type of income do I need to report in order for the K-1 to be approved?
  2. What types, if any, of documents does my fiance need from Ghana?
  3. How long are those documents valid for?
  4. Can she interview here in Uganda (We have a nice spot to stay with my sister and in Ghana we don't have an apartment anymore)?

 

Any type of insight will be most helpful.  Thank you!

1. It is Imperative you tell the truth, if you lie and they find out, it will be a denial with little chance of later approval. You need to prove you can support both of you, this means being somewhere above your states poverty line.

 

2. Don't know, might need to talk to an immigration lawyer, or simply read us Embassy websites in detail.

 

3. If a K1 visa is issued, it is valid for 6 months from the visa medical date, and once used you must get married within 90 days and apply for change of status.

 

4. If Ghana has a US Embassy it should be possible to interview there

Thank you for your response!  I would of course tell the truth during this process.  Just curious if it has to be much over the poverty line because the USCIS website states it only has to be 100% of the poverty rate.  My third question refers to fingerprints and other documentation that would be acquired in Ghana.  If she were to interview here in Kampala, how long would those fingerprint/other documents be valid for?

Most documents I've gotten are valid for 6 months (I'm UK based tho) I would be best to ask the embassy in question about documents though as times make change.

  1. The I-134 sponsor must have at least 100% of the federal poverty line for your household size. Household size includes the intending immigrant. See here: https://www.uscis.gov/system/files_force/files/form/i-864p.pdf. Once the K-1 is issued and your fiance files for AOS, the minimum will be the 125% guideline. Note again that these are minimums - the CO will take into account the totality of your financial circumstances to assess the risk of recovering funds in the event that your fiance becomes a public charge.

  3. Which documents specifically? The medical is good for 6 months. the I-134 has no explicit expiration AFAIK, but generally the documentation supporting it should be recent enough for the CO to determine that they are current / still applicable. The visa is valid for 6 months from the medical or the interview...whichever one is sooner.
  4. Yes, it's possible. However, she must maintain legal status for the interview. Given that she is there on a tourist visa and the process from filing to approval is likely to take 6-8 months (sometimes even longer for high fraud countries), I'm doubtful this would work. A quick check shows that the maximum stay on a tourist visa is only 90 days. A visa can be valid for longer than that period, but that's not the same as the maximum duration that you maintain legal status.
