I'm really wondering why they didn't cashed our check yet???

I did call USCIS and someone will call me back within the next 3 to 5 days.

I hope they will give me an answer.

I don't understand why you are freaking out yet. Give it another week and if you haven't heard from them until then, then I would start getting worried.

Your K1 can't expire because as explained to you, the moment you entered  your K1 became "expired". What you are talking about is your I-94 that expires. You are out of status afterwards if you don't file for an AOS before your I-94 expiry date. And you don't have to "go back to Germany before the expiry date". People wait months or years after that to AOS although it is of course not advisable. Again, all that happens is that you go out of Status if you don't file for AOS before.

Well it's actually the date on the stamp in my passport saying that I have to go back to Germany if I haven't filed AOS until that day.

I wonder who told you that or why you think that.

Well that's what I thought would happen if I didn't file for AOS within the 90 days. I had to apply because I want to work as soon as I have my EAD

Sorry you haven't heard anything but you really need to be a lot more patient with the process otherwise it will drive you crazy!

It's a long wait and waiting 14 days is really nothing.

Give it some more time and make sure in the future to always get the tracking number for anything sent to them.

They are a bit backlogged lately so give it some more time and I'm sure you will hear from them. Did you include the G-1145? and use the new forms and fees?

Like others also said, wait it out for now. No reason to freak out yet on two weeks of hearing nothing. You'll hear something soon and if not, contact if the package got received.

I did join the thread and as of right now it seems that even people who filed after me already heard back from USCIS.

It's not the first time that we've been having issues with USCIS. When my husband  (at that time my fiance )filed for my K1 visa and sent the documents with USPS, we found out 4 weeks later that USCIS never received the package. So we sent it again with UPS and USCIS got it after a couple of days.

He only found out that they never got anything from us because he called USCIS wondering why the check wasn't cashed yet or why we didn't receive a NOA.

I was hoping for that we wouldn't have to worry about our documents because last time UPS did send the documents and it worked. And now...?

Seems like that I have to send the whole paperwork again...likeI said, some people who filed after me, already got their text message/email.

Has everyone who filed after you gotten a notification? Has the check been cashed this time yet?

I can understand the frustration, but I would think it's worth waiting a little longer. We all know there's no hard science here and waiting times are just estimates.

My husband checked his bank account before he went to work and so far, the check hasn't been cashed yet.

I read posts from people who submitted their AOS application a couple of days before I submitted mine, and they received their NOA1 and got an email/text message from USCIS.

It's so frustrating to read that they got their NOA1 and I am still waiting for mine. I don't even know if USCIS got my paperwork.

I was like that too, people after me starting to get their NOA1's and my package either missed it's arrival scan or was not delivered. I opened a topic on it if I should re-send a new package and Harpa Timsah gave some advice on it;

Quote

The thing is that having two applications in the mix is a VERY bad idea, so I would highly encourage you to wait. USCIS will cash your check twice, or, if you stop payment on the first check, they will send a demand letter for funds. The more I thought about this, I am convinced it is already delivered and the scan was nor performed. You said the tracking showed it went to Chicago, so it is nearby the lockbox at least. USCIS gets thousands of letters a day so I bet the mailman sometimes forgets to do all the scans. I would wait 30 days from the date of sending to be sure.

You could call UPS and try to see if they can track the package where it is.
