Greetings everyone!

 

So, my first post here and up to this point on our visa journey, everything has been pretty straight forward.

 

Long story short...

We already received approval of the I-130 and are in the process of filling out the DS-260 + I-864, etc.

The issue that has come up now is that I am not sure if my mother, who lives in the US and will be filing with us to meet the income requirements since we are planning on traveling back to the US together and won't have income at first, should file a separate I-864 as a joint sponsor or I-864A as a household member.

Technically, I have maintained a permanent address in the US for the entire time I have been living here in Germany. I vote, I file taxes, I have my bank account, credit cards, drivers license, etc. and that is all registered with my mothers address in the US, which is also where we will be living for the first 6 months when we arrive in the US.  So, I am not too worried about them accepting my good faith of re-establishing domicile.

Would that technically make us household members or will they decline the I-864A? Or should I have her fill out a separate I-864 from the start so we don't have a delay in the processing?

 

I appreciate all responses and/or comments and if extra information is required, then please fell free to ask!!
