Hello everyone,

 

My wife is trying to file for AOS soon (From K-1 Visa) but my income does not meet the poverty guideline so I am going to have my dad to be the joint sponsor.

 

My question is...my dad and mom file their tax jointly so I know the sponsors household size will be 3 people (My dad, mom and my wife)

 

"My total income (adjusted gross income on Internal Revenue Service (IRS) Form 1040EZ) as reported on my Federal income tax returns for the most recent three years was: "

 

So my dad puts down the total adjusted gross income for them right? 

 

Does my mom need to fill out an I-864 as well?

For the parts that are used to determine current anticipated income, and which is compared to poverty guidlines;

he will fill out his individual income where it asks for current annual individual income (from w2). If this income is greater than 125% for the household size of 3 then his individual income can also be entered as household income. If his individual income is not greater than 125% for the household of 3, then his wife's income needs to also be added and she'll need to fill out a i-864A.

 

For the parts about past income (19a-c). One will fill out exactly what is entered on line 22 of the 1040 for that year, or AGI if 1040ez.

So he is about $1000 dollars short on the poverty guideline for the household of 3. Can he use his bank saving to pass the 125% poverty guideline for the household of 3? or it will just be easier for my mom to fill out the I-864A?

On this part, I should put down their total adjusted gross income correct?

 

 

 

 

On the first one you put her individual income, that is what is says specifically... so you put whatever the supporting documentation, such as w2, says that she made..

 

On the second one you put whatever is on the corresponding tax return line 22, that is gross income...... AGI, is only if you filed 1040EZ.
