Hello girls and boys! Decided to create an account and a topic after watched the website for one year lol!

I meet my lover last year in Switzerland, was here for a French class, next September he will come to study in the USA with a M1 visa for 10 months.

We intend to get married next year, do you know what time is better to ask for an AOS? How long before the end of his visa? Compared to the period usually for an AOS?

What you are talking about is quite frankly visa fraud. It is unlawful to come here on one visa knowing and planning to get married and file AOS. If you want to go that route file for K1 visa for him.

He don't come to marry me. He come to study, he will be across my state

You sound like he is already here on that visa. So is he here now or back in Switzerland?

He is in Swiss but he will come in the US to study for September.

So we will need to wait his return to Europe before apply for a K1, right?

he is not here right now and you intend for him to come and stay which his visa does not allow. even if he does come for the class since he is then planning on or at least is thinking of staying you are 100% committing visa fraud.

 

if you doubt what I am saying just explain your plan to cbp upon entry they are very nice and will help you get the correct visa.

Pioufff, thanks for the information!! We will avoiding that and start a legal K1 process

he can still use the m1 for the class but he will need to head back for his K1 interview and then wait for visa issuance. i would recommend trying to get the interview near Christmas break so he has some time for the process and can then return to classes without missing much.

I'm not big on K-1 visas but if he applies now won't he get it on time to be here in Sep?
