Good luck with that then. You've been informed of what the NVC standard is (a long-form birth certificate), and what workarounds are available (an NPC attestation plus corroborating evidence of birth). Be cautious when people say they got a birth certificate from local governments: many NPC offices are located in (or near) LGA offices, and you'll frequently find a tout or two promising to get you a birth certificate (for a fee higher than the official one). You're also likely to face the same issue when you apply for an immigrant visa at a US consulate in Nigeria, assuming you are going the consular-processing route.

I appreciate your concern. However, i am basing my stand on what is openly available on the US Dept of state website https://travel.state.gov/content/visas/en/fees/reciprocity-by-country/NI.html

If you have a source for your claims on the 'NVC Standard' to which you refer, kindly post same. I was born way before the NPC was established, so i have an original BC from my LG.

You know what? You're probably technically right: the wording of that section has changed somewhat since I went through the process in late 2015. Has the practice changed, though? Given your checklist, and the litany of birth-certificate woes from other applicants (you can search top right), I'm not so sure.

 

So I'd play it safe. I too was born before NPC, and I got an attestation of birth plus a sworn declaration of age by an older brother. Result: No checklist. But then I wasn't an EB-5 applicant, and didn't have the luxury of engaging in endless arguments with faceless bureaucrats in the US government.

I believe your response is well meaning, despite your attempt at sarcasm, so i would respond one more time, to clarify things.

At the end of the day, each person will do what they deem best for them. You did what was best for you with your petition, you did not get a checklist, good for you! I followed the country-specific guidelines provided and got a checklist, that sucks! Given my circumstances and weighing my options, i've taken the course of action that seem best to me. It has nothing to do with my petition being an EB-5, i'm not even sure why you would bring that up. I do not have the " luxury of engaging in endless arguments", like you put it. None of this is fun, so that's an insensitive comment. The alternative course of action would be to take a few days to get the NPC doc and resend to NVC, resetting my scan date and having to wait another 11 weeks for this to be reviewed.

 

Whatever your motive, assuming that you know another person's circumstances, or what's best for them, with the basic information available, is a tad arrogant.

Bottom line: you have been helpful, but the last part of your above comment, is totally uncalled for!

You misunderstood. I was assuming EB-5 candidates aren't under the same pressure of emotional separation as those seeking to immigrate on the basis of marriage, but I admit that was a little presumptuous. Don't miss the forest for the trees, though: USCIS can be a cold, bureaucratic engine, driven by precedence rather than rational argument and nuance. It is often easier and faster to follow what works, rather than argue legalese.

Just to let ya"ll know i finally got my CC yesterday, (confirmed today). I thank God, i was able to get the checklist overturned by His grace.

Hi guys please helppppppp, Just filed i130 for my parents and the USCIS just sent me RFE requesting for birth certificate, apparently they refused my attestation of birth. I was born in the 80s and National Population as of today refused to issue my mother a birth certificate stating same reasons cited above about giving certificate only for 1992s and later. I am in a limbo, did anyone born in 80s recently file for their parents? Can anyone please say a word even if you dont have same experience. I appreciate in advance. Thanks.
