Adjustment of Status Process

Hi all!

 

Hope everybody's doing well.

 

I just got here in the US a week ago (woot woot!) We are finally done with K1 visa (yay!) and now there is another step we have to be worried about: AOS. I just have a few things that need clarification. 

 

So here are the questions:

 

1. I found this link on Google for the updated forms on AOS: http://www.visajourney.com/content/adjustmentforms and I have noticed that everything but form G-1145 is not updated and has an expiration date of Sept 2016. Is it still the same form used all over?

 

2. For tax forms/transcripts, is it required to give the last (3) yrs of tax records OR the previous year would already be enough?

 

3. We are filing for AOS by the end of this month (March), and since the tax season hasn't come yet, just wanna clarify, we can only provide until 2015, right? (since 2016 is not available yet)

 

4. Would it be okay if anyone of you guys is able to post here in the comment section of this post about the (complete) set of requirements for AOS/EAD/AP? I have been seeing different posts on other pages and it gets confusing as some items are not listed on another person's list so on and so forth. I just want a clarification on the right list.

 

Thank you in advance to anyone who would be kind enough to answer my questions. Please know that I will use the answers I will be given  to help other people who would face the same issues in the future.

can't answer to all your questions but 1)

I'd always get forms straight from the source, which is uscis.gov  Here's for example the I-485 form, and yes, it's a new one: https://www.uscis.gov/i-485

 

Not sure who updates content on this website but it's run by volunteers (such as yourself). So you can't always assume it contains the most up-to-date info/forms

Hey I hope i can help for some of your questions. Also, welcome to the US of A!

 

As DrEllaNJ has mentioned 1. When in doubt about the forms go straight to uscis.gov https://www.uscis.gov/g-1145

 

2. Again, the first place I always go is the USCIS form pages to look at the instructions. This is what the instructions for the I864 affidavit of support say "You must provide either an Internal Revenue Service (IRS) transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years."

 

3. This I am not sure about. I've already done our taxes for the year so it's available to us. Is there a reason you are waiting to do taxes? If you can get them done in order to submit them to immigrations, why not? Just throwing the thought out there

 

4. https://www.uscis.gov/i-485 Straight from the gov't what they are looking to get. We sent AOS stuff very quickly after we got married at the courthouse and sent the following: Apt lease signed by both us, Bank account signature cards to demonstrate joint finances, copies of credit card in which he was an authorized signer.....and now my memory is start to go bad but those were just a few of the things I could add his name to in such a short amount of time.

 

AP -https://www.uscis.gov/i-131

EAD - https://www.uscis.gov/i-9 Read the instructions there and it will tell you what you need. I don't want to write a novel and take up all this space.
